State Specific Question About: CALIFORNIA (CA)

Tenant reported leaking in the bedroom. About 24" x 24" area of carpet is wet, but we removed half roof of padding to prevent smell. The carpet was really dirty already.

The next day, roof guy came and fixed the leaking problem. We told tenant a carpet guy would install new padding and shampoo carpet after that.

When the carpet guy came, he told the manager that there was no carpet in the bedroom. Tenant removed carpet and dump it in the trash bin.

Today is the 5th days after the roof leaking incident. We fixed the roof and install new carpet already.

Can I served a 60 day notice to move out to this tenant? Thanks, --172.89.xx.xxx

Yes, you can SERVE a notice to vacate, BUT:

Beware of two possibilities:

One is that the tenant can turn the situation into an untenantability complaint, and he could refuse to move, complaining retaliatory eviction (or move and ask for damages from you). Maybe its not enough to replace pad and shampoo. How old is the carpet?

Second, is that you will have to make sure that he is not charged for replacement of the carpet.

We take care the problem first. We don't want to argue with tenant because it would not help anything. No replacement cost of carpet was discussed.

The unit had new carpet when tenant moved in in year 2013. What should we do about the carpet that tenant removed without permission that was still in good shape, just need to shampoo carpet.

New carpet in 2013.

Removed by tenant 2016.

Landlord needs to replace.

So, replace, tenant owes 4/7 of the cost, provided that you can prove age of the carpet AND that replacement was not necessary after being leaked on.

Tenant removed without permission is not relevant.

Carpet was in good shape is not relevant.

3/7 of the cost is on you. Remaining 4/7 is on him, IF you can convince a judge that the carpet didn't need replacement. The latter will be a tough issue to win in court.

I would simply replace the water-damaged carpet at my own cost. Don't think like a cheapskate.

and if the guy did nothing and let it stay wet and soak the sub floor you would be complaining about that.You need to thank the guy for caring and doing what he thought was best and just replace the carpet and be done with it.You can attempt to save the relationship and keep a paying tenant or upset him and have him feel disrespected and move out even if you don't evict him. --24.25.xxx.xxx

Damaged carpet and wet carpet are two different things.

Is this the only issue with the tenant? For you to just be done, I would assume there have been other problems?

If this is the only thing, I agree with plenty that you should just eat it and forget about it. If the carpet toss is some type of retaliation for a previous instance, maybe time to get them out and on to less dramatic times.

Me? Res removed good carpet with a small wet patch that could easily be dried without permission. My lease is clear: replacement cost. Let him argue about depreciation or return the carpet in proper condition.

Lesson: NO MORE CARPET!!! It is a constant maintenance and management problem with high expense!

If this is a bottom floor to be without a carpet might be fine, in an upper floor the noise will be an issue and you will have tenant noise fights. I put in Allure in a upper floor in 2 properties and feel it was a big mistake. --96.236.xxx.xx

Yes, we will move on.

There were some other issues in the past: unauthorized occupants, threat to call city inspector, deduct rent for parts replacement without reporting to manager first.

Just found out tenant changed wall color paint to red and black in the other bedroom because his daughter likes it. Give them a notice to change it back, and tenant said they will call the city inspector. Manager told tenant to let us know when the inspector will come.

We fixed roof, ceiling, and replaced new carpet, so we are not worry whoever will come to inspect. This is a 2nd floor unit, so no tiles or hard surface in bedroom and living room area. We installed ceramic tile for all first floor units.

We will wait for a couple months and give them a notice to move out.

If someone's carpet gets wet - you pitch it? Why couldn't the carpet have been dried out and saved? It appears it was time to get it shampooed. Who is on the hook for that in your lease - in my lease....its the tenant --24.239.xx.xxx
