State Specific Question About: VIRGINIA (VA)
We have a resident who wrote a bad check for rent. Has paid rent but not bank fees. Also owes monies for fire damage. Agreed to pay $25 weekly to meet the $1000 insurance deductible. Can we apply rent toward fees and proceed with pay or quit? Or do we need to send certified letter stating that monies are for insurance deductible and then send pay or quit? --73.147.xxx.xx |

I don't know anything about VA, but in general, moneys that are given for a specific obligation must be used toward satisfaction of that obligation.

I'd send the tenant notice to pay all charges due under the lease or we will be proceeding with eviction as soon as legally possible.
I'm with Vee....very small chance that $1000 is going to come back to you. Resident will get tired of paying and move on to greener pastures. Unfortunately, since you agreed to it, you have allowed it. So unless he fails to pay, you're stuck waiting for your money.
Any further damage to the premises must be paid immediately upon demand, or evict for damage to the property. --173.19.xx.xxx |
