3 weeks ago, I sent a check to a tenant for their security deposit (with a note of what was deducted). It still hasn't been cashed. I have emailed the tenant to ask whether they received it but have gotten no response.

I sent the check to the (new) address that they had given me.

I don't think they're pursuing legal advice due to what I withheld, because THEY actually left before the lease was up. I reluctantly agreed to this as long as they left the oil tank full. (This is all in writing.) The amount of the deposit I withheld was just the amount it took to fill the tank.

Is there a set amount of time (a few months, I'd assume?) that I must wait before I put a stop payment on the check?

Only put a stop payment on it if they ask you to reissue the check. They have as long as they want to deposit it. The only limitations would be if your bank will only honor the check if it is processed within so many days of when it was written, and even then that would be up to your bank to enforce, not you. If you stop payment without them asking then you are setting yourself up for trouble. --70.178.x.xx

Keep the paper trail and ensure that you keep that check amount in the account. Only if they contact you and state "we didn't receive please resend" or something to that affect should you do anything with that check.

It's only been 3 weeks - I wouldn't worry about it - I've personally held onto checks that long - just not "needing the money" or even put it in a folder or in a stack (or maybe their mail is being held as they are traveling) - not your call in any of those instances. 3 weeks is nothing. --69.201.xx.xxx

Is the uncashed check throwing your books off by $20 or by $1000?

I once had a tenant who was splitting up with her boyfriend, so they both left my house. I refunded $x-- but both of them had to sign the check, which they did. She argued one item on the SD accounting, so I gave them a check for the $20 that it represented... but it was too much of a hassle for her to go back and get her ex-boyfriend's signature so yet another check could be cashed. KH: You should look up the escheatment rules for your state to determine what to do. Statements that you've "done your part" and can now just ignore it forever are incorrect.

You HAVE done your part for now -- you can let it sit for quite a while now. But, eventually, if they never cash it, you have additional responsibilities that will kick in after 6-12 months (depending on your state). Eventually, you will likely need to send it (or, at least, report it) to your state's unclaimed funds department.

Did you get the photo delivery by fedex or the green card from the signed delivery? Otherwise they could easily head to court and demand double/triple the value depending on your local tenant laws and the method of delivery you choose, you will need proof of delivery to bolster your case. --76.188.xxx.xxx
