State Specific Question About: CALIFORNIA (CA)

i have a four-plex in Los Angeles County, and LADWP (Los Angeles Department of Water and Power) took it upon themselves to start charging each tenant for the trash service. When tenant called me regarding same, I emailed LADWP and their response was that they are now charging trash to any and all electrict service (since tenants pay their own electric). My question is this, can I send a letter to all tenants stating from this day, I will no longer pay for trash pickup (even though rental agreement states I will pay trash and water???? --47.146.x.xxx

Are you including the amt for trash with the rent amount or is it separate?

If separate, pay the trash bill amount to the tenant. If together, make adjustments to the rent payment.

I would pay it until the lease reup, then change that provision in the lease and point out the change to the tenant. Make adjustments to rent accordingly. Comparable market rent increase minus trash service.

As always, check your CA ll- tenant statutes.

If your lease specifies that you pay trash, then you are obligated to pay trash.

If any tenant is on a month-to-month, you can amend the terms with 30 or 60 day notice. As to tenants still under lease, no, you have to pay it.

What LADWP did about billing is irrelevant.

Is trash service flat rate or per bag. Is there a recycling option available to reduce the amount of trash. Here the local towns charge $2 dollars per bag where do not pick up recycled mixed in with food waste. The tenants will have to reduce the amount of trash if the recycling option is available. Many cities are looking to extract more out of everyone including tenants as they know tenants are least likely to take legal action against the city. Visit some of videos on You Tube about the inspections done by city. So if the city wants to do this way then the tenants will have to pay the city. Most cities that have rent control generally there is no vacancy rate so for tenants it is take it or leave it. You do not have to earn one business. A trip down by bus station then one sees the large homeless problem that exists. --74.220.xxx.xxx

One thing I am not 100% clear on is the city providing ADDITIONAL trash service, or is the city surcharging the tenants for the service YOU are already paying for? I'm assuming the former: there are two trash services being provided.

Lease agreements (contracts) typically can only be amended by signature of all parties involved. You cannot send a letter saying, "Guess what? Because our city is dumb and changed the rules on us I've decided to stop doing X even though I agreed to do X."

Rather, you need to educate this tenant about the advantages of making the change you desire and get his/her/their agreement. This should be a no-brainer. There is no need for TWO trash services. Especially when the cost of the trash service you provide is "baked into" the total rent paid. I think this is an easy fix, provided you do it properly.

I'd call them and say: "Hey Joe (cue Jimmie Hendrix!), since your rent includes trash service, how about I drop your rent $10 per month and we discontinue your service that I'm providing? You can still use the city-provided service." Write it up, both parties sign and date. Nice and official.

On the other hand, if there is only one trash service and the city is simply hitting your tenants up for extra money, then I would say, "Hey Joe, unfortunately the city has decided to charge you extra money for a service that you're already paying for as part of your rent. Here is a list of the city council members that voted for this ordinance and their phone numbers. Be sure to let them know how much you appreciate being double charged." --173.19.xx.xxx

The DWP and Los Angeles Government will charge tenants on their electric bill for trash service even if each tenant isn't provided with a Black, Blue or Green trash bin. Even if you have a private trash collection service with a large 3 cubic foot dumpster and no city bins -- they will charge you just the same. The City Government will not let you opt out of paying for the City Trash Service.

I have sued the City for my 16 unit, a 5 unit and my home because of this issue. This is Fraud against the tenants.

Gubmint strikes again.

"We're here to serve you" with a bigger bill!

My business would be an absolute no brainer if the city and others stopped making changes.

Me? Everything is negotiable. Get solid info regarding bins and pick ups.

But thinking...if you are required to pay for trash service to the multi building then you are fulfilling your lease.

If the util co adds something to a private person's bill (the resident) that is between the util co and the resident.

Will wonders ever cease to come out of Cali? I am so thankful to live in the Midwest!
