State Specific Question About: OHIO (OH)

I'M a landlord in the state if Ohio. I currently have a tenant that has recently lost his wife 2 months ago (also resided @home & on lease) and Ive gotten word from his stepdaughter that he is now in the hospital! I am a very reasonable person & fair, so I understand that life sometimes will present issues that we can't control. However, its been 12 days & no rent has been received for the month of Oct. Not to mention that August rent wasn't paid due to loss of his wife. During that time ALL communication lines were clear & open. I spoke with husband & payment arrangements were made. This was 1st time encountering rent payment issues, tenant has been with me for 9 months. Moving forward Sept rent paid & now here we are with October! No rent 12 days late & tenant is in hospital. I have called him & text no response. Taken drive bys pass house to ensure my property was good. I was informed he is in our local VA hosp and in a unit where no visitors or phone calls (Hmmmmm..) How should I proceed? All i want is communication & RENT $.. All advice will be greatly appreciated . --74.140.xxx.xxx

You aren't going to like the answer. What you want is rent and communication. There is a 99% time you will get neither.

I'm not exactly clear how many month's he's behind at this point. Was he caught up until Oct? The reason I ask is many land lords have screwed up accounting systems that allow Sept rent to be paid but August rent still isn't. Nope...rent is rent. There is no "August, Sept, October" rent. There is simply Rent. The only reason I ask is that it's time to add up how much you have lost to see that it's almost impossible for him to get caught up even after he gets out of the hospital.

Yes, "life happens," and yes people should be prepared for life to happen. Does his sis-in-law have any money and she can pay his rent until he gets out? My guess is no or she would have already volunteered to help him out. Every day lost at this point is more money out of your pocket. Unless you went into this deal planning to give free rent to people when they go into the hospital, time to deal with this situation.

Life happens a lot: people get sick, injured, laid off, car wrecks, etc. Good tenants prepare for these things and have fall back plans to ensure their obligations are met. Bad tenants have no plan and expect the land lord to go without rent until they can get caught up, if ever.

You're not getting paid: file for eviction ASAP. Your goal now is to limit the loss you suffer. --173.19.xx.xxx

Sorry to hear this. My first question is why do you want to visit? Your heading down the rabbit hole. Whether in the hospital no rent has been paid.

Unless you are taking on the burden of taking care of him. you have a business to run and this is tough but you said the Stepdaughter knows about you. Family should be stepping up to care for - not only him-- but his bills.

Call stepdaughter, only because she stepped up before. Let her know that tomorrow your filing for non payment of rent with the appropriate court to evict. Unless the rent is paid you have no choice but to move forward. Since they are not on the lease they will have no way of knowing when the sheriff will show up and put the Tenants items out.

Post the 3 day notice today. On Wed take a copy of the 3 day notice you posted and go down to the court house and file the unlawful detainer. This will not get better. You have gone over and above with missing the August rent and allowing him to be late this month. I know it sounds cruel but how long are you willing to carry another personal financially? I think you made an accounting mistake, just a simple correction so the amount paid on the account in Sept was for August rent, then after that correction you must follow your local and OH5321 tenant rules - post a 3day notice then onward to court to file unlawful detainer (eviction), then let the court do the job they were hired to do, the only response when family calls is the late rent fee, filing fee and actual rent is $xxx and if you want to bring that to court to pay our small company that is fine, before court it must be in money orders or cash only in full. --76.188.xxx.xxx

My sister was just hospitalize for 21 days and had

surgery. She was so sick we thought she was going to die.

She requested I bring her mail (bills) to the hospital

in Louisville so she could make sure her bills got paid.

Being in the hospital is not always an excuse to avoid

your bills.

I would serve him with a notice to pay or quit.

Having worked in VA Medical Center it would be most UNUSUAL that a patient would be in a unit with no visitors or phone calls unless they were either infectious to others or so ill that others were infectious to them. Even then precautions could be taken in regards to visitors.

However; as others have said there is no reason to visit this tenant.

You have contact with the stepdaughter. You should be asking her how the family plans to continue with the rent. If the response is not positive then begin the process of eviction. Sorry but this is a business.

Since you have had communication with the step-daughter, I agree with those who say to contact her, let her know what is about to happen and then go forward with posting your notice and starting the process---you are not financially responsible for your renters.

Unless he is in a coma, or is otherwise completely incapacitated (like a severe stroke or heart attack) there should be no reason he can't have his step-daughter get a check to you.

If you can't get a hold of the tenant contact the daughter and let her know that you will need to start the eviction process unless rent gets paid up by someone.
