Jason and PA landlords who may benefit:

Jason made a post (I think in 2012) about garnishing wages. He mentioned that you must name the employer in the writ of attachment which means you need to know where the deadbeat tenant works. He further mentioned that if a tenant changes jobs, he'd like to know of a way to find this out (due to privacy concerns it is almost impossible to find out).

Well, I may have a way that works some of the time.

In my lease, I have the tenant agree that if the lease is broken and owes money, the tenant gives the landlord permission to do credit checks/reports on the tenant. A credit report many times has the employer listed on it!

So there IS a way, but it may not work every time.

Also note that an address will be revealed too if it is not known where the tenant lives to perform a writ of execution (seize personal property).

I have them sign a release at the beginning giving me permission to pull credit, check employment, finances in general, etc., any time during their tenancy and at any point after terminating tenancy if they owe me money, proven by a judgment.

I've never gone after anyone's personalty ... for my tenant pool, that would be a "scare tactic" as I certainly wouldn't want the stuff and if no one bids at the sale I'd be stuck with it instead of my money. For a higher income tenant pool, that would be my go to method. --72.70.xxx.xx

Someone posted just a few days ago that it is explicitly against the law to pull credit on a former tenant unless you have a legal judgement against them (which I guess if you are able to garnish, you do.) But for those who are just looking to find people to serve or whatever, you can't use this method. --173.22.xx.xx

I'm not a member of any association but probably should be. I own a 12 unit plus 2 duplexes and never have any problems because of my screening policies, so I never needed any help on anything.

This is the 1st time in maybe 10 years I have someone who owes me rent.

So what's skip tracing? Is that doing research as to where a person moved? If it is, I wonder how they do it and if we can too?

Jason, as long as I have your attention:

I am about to do a writ of attachment (garnishing wages) and I found your instructions on this site from 2012. They match up with the research I've done but have only one question.

Once the bank returns the interrogatories to you indicating there is money in the tenant's account, an attorney online said that to actually GET the money, you (the plaintiff) must file a "praecipe of judgment" with the prothonatory against the bank.

I looked everywhere online to find that form for PA but can't find it!. Did you find something or do you have an example of one?

UPDATE:

I was guessing since it wasn't in any forms in the PA Code, I thought it may be as simple as a general statement to the Prothonotary. So I made a sheet with the case caption and the statement: "Enter judgment in the above captioned matter against _____, Garnishee for the property of the defendant admitted in the answer to interrogatories to be in the Garnishee's possession _______(Describe Property)." My goal was to give it to the prothonotary and then hope they'd tell me what info was missing and what I'd need to add to it. But to my surprise, I submitted it (just today) and they said that's all I need! So they entered the judgment! So now I just learned that I must send the judgment to the bank to get the money. --73.230.xxx.xx
