State Specific Question About: CONNECTICUT (CT)
My tenant has placed a fire pit (propane) and a tank on the patio behind the apartment. The lease specifies that the yard is for the landlord only, that the tenant has use of the driveway, garage, and, of course, the apartment. The tenant is leaving in a few weeks, however, I have workers coming in a week to do tree work, etc that will render that portion of the property off limits even to me due to the danger. I have asked for the tenant to remove the items, but as the tenant is moving out in 3 plus weeks I am being ignored. Was considering sending a certified letter demanding the items be removed and also notifying the tenant that that portion of the property will not be accessible for some time if the items are not removed soon. I'd say, Due to the risks of damage to your personal property, it is imperative that you remove the items from the patio as soon as possible. Routine tree work will take place next week and continue intermittently through the end of the month. We cannot be liable for your personal property, and cannot remove these items for you.

I would tell him that tree work starts on whatever day and anything in the way will be considered garbage and removed the morning the work begins and I wouldn't say it again,then on work day I would either throw it away or leave it and let it be damaged,when he cries about his stuff after the fact I would tell him I assumed it was not his stuff because he was warned so why complain to me --24.25.xxx.xxx |

Kathy, that fire pit has to go immediately. There was a case here in Ontario in which a tenant installed a fire pit on a property. One of their guests was drunk and fell into the fire pit and was badly burned. The guest then sued the landlord on the basis that the tenant was a man of straw (no money or insurance) while the landlord had assets to go after as well as a healthy liability insurance policy. The landlord was held liable under something called occupier's liability which attaches to landlords. The landlord was held responsible for $265,000 in damages. Remember this was in Canada where things are in general less litigious than in the US. There is no way I would ever allow a fire pit to stay on my property. There are no benefits and there are potentially very large liabilities. So I would have someone remove the firepit right now. --129.100.xxx.xxx |

Kathy, that fire pit should never have been there to begin with!, if your Insurance had an inkling,they would probably drop you right away. Appreciate all the feedback. As usual, it's excellent. I sent a certified letter today that not only was there a lease violation, but a fire hazard as well. The tenant had until Monday to remove (with certain conditions, namely that an insured mover or a properly insured tenant do the moving upon notifying me as to the the time and date). If not removed by 9 AM Monday, I would file a compliant with the police that the tenant left hazardous items on private property and had to trespass in order to do so. --50.138.xxx.xxx |

Closing remarks. It worked like a charm. Tenant removed the offensive items today. However, tenant did not notify me beforehand claiming didn't read the certified letter that the tenant signed for earlier in the day. Really? --50.138.xxx.xxx |
