I am not in NY so I don't know what "trustee over property" means. In most (actually probably all) states, there are intestacy laws for this type situation. --72.70.xxx.xx |

YOU ARE renting the property and want to become the "trustee"?
How do you know there wasn't a will? --69.201.xx.xxx |

We just went through the death of a relative in NY. Believe me, you are not going to become a 'trustee' that easily. Our relative had a very straight-forward and simple will, and it still took a year to settle the estate.
Our relative was in her 90's, had never married and had no children - NY required that the attorney search out ANY and ALL relatives not mentioned in the will. Even though it was very clear that she was NOT leaving anything to anyone she didn't specifically mention, they had to be notified in case they wanted to contest it!
The attorney even had to prove she had never had a child out of wedlock given up for adoption (luckily easily done - a hysterectomy at age 18.)
And there were a great many nieces nephews grand nieces and nephews etc...
In the end the will was probated as she had requested, but it was not an easy process, that's for sure. --173.22.xx.xx |
