State Specific Question About: CONNECTICUT (CT)

What are my options for a tenant who has is leaving at the end of the month, but has not paid me rent? In the past the tenant has always paid on the first. I am informed that movers are coming mid month. Desires a walk through on the 31st. According to the lease, the tenant owes me an additional $50 per week the rent is overdue. The security deposit will not cover the penalties and any damage. The back window was removed by us in order to easily move in the tenant's sofa, and therefore, I believe, the tenant requires Landlord cooperation in order to remove said sofa as the lease states the tenant does not have use of the outdoor area except the driveway to get to and from the apartment. This tenant has been very sneaky by not giving sufficient notice, but pretending to by back dating any correspondence. Do not trust at all. Should I send a notice that unless paid promptly I will start eviction proceedings which could result in a poor credit rating? --50.138.xxx.xxx

Why not post the correct notice for unpaid rent and follow with the filing of eviction, the tenant knows they are sneaky, just follow your state/local tenant laws which you should already know before opening the business. --76.188.xxx.xxx

That is what I do. Post a notice and move forward with eviction. Security deposits are not last months rent. What happens if they don't move? Then you have to start the process late and lose more months rent. --173.170.xxx.xxx

The best option is to file for eviction now based on unpaid rent. Don't bother sending notices: those will be ignored. They KNOW being late affects them.

As for backdated correspondence...be sure to keep the envelopes everything comes in. Postmarks might be useful. If it's an email or text, take a screen shot with the date of the email easily visible.

But the bottom line is the rent isn't paid. That's your main concern at this point. --173.19.xx.xxx

Yup - agree with the others to start the process of eviction now. It DOES NOT MATTER if they are leaving/gave notice or not. They need to pay if they are looking to stay through the month.

I have one that I'm sure I will be doing the same to tomorrow as they have already said "but can't we just use the SD as our last month's rent?" NOPE. "Oh - didn't we pay last month rent when we signed the lease?" NOPE.

Yea I got that too. "What about our last month's rent." You mean your deposit?

Here is what I have done on 2 occasions of "just use our deposit".

IL law has 5 day pay or quit period. I went and talked with them directly. I said, "no i cannot do that, but here is what I can do. You be packed and out by the 5th and I won't start eviction." (Because I can't by law, anyway.)

Both times it was "Let me ask my wife" and both times it was "Ugh no here's the rent." --63.252.xxx.xxx
