State Specific Question About: TEXAS (TX)

What is the best way to reject a smoker if the ad reads "No smoking and no vaping allowed per lease agreement" ?

Unfortunately, I do not have this listed as one of my rental requirements, it is only in the ads.

Since I am only the "Manager" and not the "Owner", please let me know your thoughts on the below email:

" I received your application and submitted it to the owners this morning for their review.

Unfortunately, they are unable to approve your application at this time since your application indicates that smoking would occur on the property.

The advertisements for this particular home specify "No smoking and no vaping allowed" and unfortunately this applies to the entire property and not just the interior of the home. "

(I found out they were a smoker after accepting the $35.00 app fee)

Since I did not run a credit/background check on them, am I obligated to refund this $35.00? I feel I should return it just as a good business practice since it was not used.

Please let me know what you would do!

If it said "no smoking and no vaping" in the ad, and they applied, I would reject the app with a note: "You do not meet our rental criteria. For more info, please send a self-addressed, stamped envelope to...." message, pocket the $35, and go have a beer. What's the point of charge an app fee if you don't intend to keep it? --173.19.xx.xxx

We don't call people to tell them they were denied.

IF he calls we simply say the application was not approved. (Note I said APPLICATION, not YOU were denied - too personal)

IF he presses I would simply say "This is advertised as a non-smoking home."

In real life: there is no way to police smoking. People will lie on the app so you'll be approving smokers anyway. People WILL smoke and vape in your homes no matter what you say. Carpet free makes this much easier.

The 2 Minute In-Home Visit before final approval will show you if his smoking is a problem.

My lease is clear: smoking in the home may lead to higher cleaning costs.

you are over thinking....the app fee is yours. there is no connection to your expenses. my houses are no smoking and clearly stated in ads. as yours was. they applied knowing the restrictions.. deny them for being smokers.. --166.137.xxx.xx

Is reject for another reason. Or return the fee because it was for credit report and one wasn't run, this is why i also charge an application fee of $10 first screening, pass that then i get the credit report cost --66.87.xx.xxx

If they were honest on the application, and their application is denied, I refund the fee even if I have run credit or called references. I take it as a cost of doing business.

If they are dishonest about anything, their application is denied, and the application fee is not returned. I tell them upfront if they are concerned about the fee.

But I email potential tenants a short pre-screening form before I set a viewing appointment. It saves everyone time, as not all potential tenants are serious or read the listing. Confirmed smokers do not get an appointment, and do not make it to the application stage.

The prescreening form lets me tell them nicely that the place is not a good match for them for a variety of reasons. Hope this helps. --76.90.xx.xxx

I would return the fee I collected if I hadn't used it to process the screening.

I would consider this my failing. I put it in the AD and it's in the lease. But as part of my prescreening I do remind them that it is a smoke free property and ask them if this is an issue for them.

I realize they could lie but so far, they haven't.

In one case before I was more careful I found out a tenant smoked after agreeing to rent the home to him. I told him it would not work out because I simply could not have smoking in what was a newly renovated house. I have nothing against smokers but it simply caused too much damage inside the home. He begged for a chance to prove he would not smoke in the house. He won. Turned out to be a great tenant with no signs of smoking inside but I didn't make the same mistake again. --173.170.xxx.xxx
