State Specific Question About: ALABAMA (AL)

Hello All,

I received a judgement in April on a tenant for back rent and possession of the property tenant and I had an agreement to pay a certain amount until they caught up. The tenant file chapter 13 in May and stop paying rent last month now tenant is two month behind Aug.and Sept.My Question is does the tenant still have to pay rent or do the chapter 13 allow them to stay and do not have to pay rent what are my option if I wont to get this tenant out.Any Help will be appreciated. --50.147.xxx.xxx

You will have to go to bankruptcy court to get permission to do an eviction,hire an attorney who can do it otherwise they will be living there for free --24.25.xxx.xxx

Go forward with the eviction. You may have to stand in line with other creditors for the back rent, but you don't have to provide a rent-free house until they figure it out. I'm wondering what the heck the BK attorney told the tenant? --76.238.xxx.xxx

If you got a judgment of possession in April, why is the tenant still in possession?

You need an attorney who knows both BK and eviction. Do not do this on your own, because there is a good chance you would mess it up!
