State Specific Question About: NEW YORK (NY)
I had a month to month rental agreement with my tenant. in mid Jun I asked him to move at the end of July, he said his new place would not be ready till mid august so I let him stay. At the time I told him to move I sent him a notice of rental agreement termination 30+ days in advance of the requested move date. He moved in late august and is living in another apt. He left behind a large number of belongings mostly clothing and sporting goods. He is moving things out very slowly but not to my timeline. I want to get rid of all his things so I can begin remodeling work how do I go about this he's not cooperating with as much stuff as he has remaining I doubt that he'll be out in several months? --98.117.xxx.xx |

Eviction if he is garnishable.. turn the 30 day notice to your attorney.. Other option is to get the tenant's cooperation to store his stuff in basement or somewhere else. Make sure he agrees to it --173.48.xx.xxx |

Has he or is he paying you rent (current) through the month? If so - then you are "allowing" him to stay by paying/accepting the payment.

I'd give him written notice to "remove his items with a clear, firm deadline (I give 3 days) and notice that any items remaining will be disposed. Please respond"
Text works for me, especially if he responds, proving he got the notice.
