State Specific Question About: Virginia
I rented out my house while stationed overseas for 3 years. We had one tenant in the house for the whole 3 years. She just moved out and we found the following issues. She did not properly clean - carpets we not professionallying cleanedo as required by lease. Only 2 not all 3 chimney flues were cleaned (again specifically addressed in the lease). Windows were not cleaned- professional cleaning is not required, but "thorough cleaning" in lease. Biggest issues are with flooring. Basement carpet and pad ruined with cat urine. According to assessment base boards and about 2 ft of drywall need to be removed arounfrom most of the perimeter of the largest room. Of course it then needs to be repainted. She also put down carpet over our ceramic tiles and destroyed the tiles while removing the carpets. She claims that because she was not given a written report itemizing the condition of the Premises at occupancy and was not invited to a walk through inspection after move out- she should not be liable for any damages. What are my options?

Sounds like your former tenant has been reading the Virginia Residential Landlord and Tenant Act.
Is this your only rental property? If so, you are exempt from this act which excludes those who own two or fewer rentals in Virginia.
Your options are to sue her for these damages if they exceed the security deposit.

Gail seems to have answered your question very well.
However, there is a practical issue -- how do you prove the damages? Without a Move-In Inspection Report signed by you and the tenant, how do you prove the condition of the property at the start of the lease? I take lots of photos at the inception of the lease, and I hope you did! Those photos, combined with the move-out photos, prove the damages. I take the move-out photos from the same angles and I present before and after photos to the judge for easy comparison.

We have pictures -I am sure not as detailed as yours Mike. We can get a statement from our friend who passed on the keys to the tenant as well as the people who worked on the house and the cleaners who wete there before it was rented. We have her own emails and pictures showing the carpet she put down over our tiles and we of course have the after pictures of the carpet and tiles

Bagged samples of cat urine ruined carpet can make a...shall we say...stunning impression on a judge if this ends up in a lawsuit.
