Served an eviction notice to the tenant for breach of contract. They asked us to let them stay in the property until the end of the contract as they will correct the issues. Advised that it will be depending of the results of an inspection, which was scheduled 2 weeks after the eviction notice.

The day of the inspection, we asked her for the garage key (only one key:our mistake). She said that her husband had it on his key chain. Advised that we will get back on our next available day for an inspection (3 days later). She said "don't worry about the garage, he only has some bikes there". Let her know we need to inspect every area of the property including the garage. Friday came and they don't answer the door, went back 2 hours later and no one answered. In the evening, served the eviction notice.

Not exactly the same situation but...had a tenant (husband, wife, two young sons) who had not been renting for very long. Five months into the lease he claimed he "might" get a job transfer to Savannah and that his wife had lost her home job.

I reminded them of our buy out clause in the lease (30 day notice, 2 months worth of rent).

At the beginning of August he texted they decided to "try to stick it out" but rent would be late (paid on the 6th) with the late fee included.

The sixth came and went with only the sound of crickets. Three day Pay or Quit notice sent out on monday the 8th. Wednesday the 10th I drove through the alley behind the house and noticed the double gates were wide open. These tenants had an outside dog. I stopped, went in the back door and SURPRISE! the house was empty; tenants had taken off.

I do file for an eviction even though they are gone. It's cheap to do in my county The only punishment these folks will suffer taking off like this is getting a judgment on their credit history that will follow them for a while.

The lesson learned is what my father used to say; how can you tell when a tenant is lying? When they open their mouth (or, in this case, their text). The Pay or Quit notice should have been sent the second day of the month. And you should have continued on with your initial eviction notice.

Since you have given them a eviction notice (which was the quit notice, correct?) ---FOLLOW THROUGH till the end--evict them.

Their excuses regarding the garage means they are hiding something and trying to put on over on you. I would never wait 2 weeks to do an inspection after I had found they violated the lease. It would be immediate--within 24 hours.

This is another good reason to do regular inspections of your rental units. I have a clause in my lease regarding inspections. If they get testy about it, it's time for them to go. --65.114.xxx.xxx

Sounds like the correct thing to do, have you been to visit housing court so you know the proper timing for each of the other steps coming ahead soon? If not sure it is best to hire a flat-fee eviction service lawyer to carry out the remainder, it costs me about 350-400bux for 2 court sessions for this and that is it,no more playing ping-pong with the tenant for routine service. --76.188.xxx.xxx
