State Specific Question About: CALIFORNIA (CA)
Received this email from a tenant today. I called the pest company and twice they have failed to show up to the unit. However, it seems that even with the "infestation" he is willing to live in the unit for another month. Any advice?:

I would like to formally inform you of my intention to end our rental agreement at 12pm on September 15th, 2016. I'm citing california civil code 1942 due to an infestation of pests, which you have been notified of and have failed to rectify in a timely manner. There have also been several issues regarding unnatural noise from my neighbors, and odors from the garbage bins which are set too close to my entryway. I will be terminating all utilities on September 15th. I can be reached here or at XXX-XXXX for setting up an appointment for a walk through. You will receive a notarized copy of this letter shortly.

I believe i would call him and ask for another opportunity to make this right for him. Apologize for the service not showing up. Don't make excuses, ask for an opportunity to hire another company and you will met them there, call and call until you can get one to come out today or ttomorrow, if the tenant will give you that opportunity . Get a new pest company. He is giving you 30+ days but he could probably make it shorter due to the infestation.

Digging into the situation it appears that the pest company DID go to the property on Aug 2nd! I just opened my mail to discover the invoice. I also wrote the tenant an email prior to finding the invoice telling him I wanted to fix the problem. He writes back and says he is moving to NV for work.

@Mike -- the noise he claims is that a tenant is hammering and using power tools after 7pm.
I had my pest guy go to his unit two days ago and the "infestation" is fleas and ONE roach. It was a big flying roach that came in probably through the drain.

He's really leaving to take a job in Nv. The "infestation is a excuse. You have acted by getting the pest control out. You have proof of that.
As California is a mitigation state you can't stop him from leaving. But you can tell him he has to pay for the time until you find another tenant.
Personally I don't want anyone in my rentals who doesn't want to be there. I rather get them out take possession, but explain that they are liable for rent payment until I find another tenant.. As they want their deposit back they must provide a forwarding address. Then you can take them to court if they do not pay
Make sure you have documentation of the property when you first rented it, and after vacancy.
You have 21 days to refund the deposit less damages. I suggest you start advertising it ASAP. Unless you're in the middle of nowhere you'll have a tenant fast. Our rentals are never vacant (only between tenants and that's down for repairs/maintenance --76.247.xxx.xxx |
