State Specific Question About: NEW JERSEY (NJ)

Can my landlord tell me a time to move in? We signed the lease over a month ago and the dates specify August 1, 2016-July 31, 2017. No times are mentioned. I was just notified today that any time after 12 is okay. The movers are already scheduled to come at 9. Can they tell me a time this late? --107.15.xxx.xxx

I don't know NJ laws but I allow a move in as early as a tenant wants. You are paying for the property from 12:01 AM.

I do not know NJ law, and I have not read your lease or any rules that might apply. Home Owner Associations, local gov't, whatever, rules might limit move-in times.

I frequently have the lease signing and move-in inspection on the day of the move-in. The new Tenant is not allowed keys (and is not allowed to move in) until the lease is signed and the property inspection has been completed. That could be at 9 a.m., 5:00 p.m., or any other time that day. Once the lease is signed, all move-in funds are paid and the inspection report is signed, the property is the tenant's!

This landlord may be used to doing it this way throughout the years. Ask for the unit "as-is".

They may have a pre-lease ritual of cleaning, dusting, who knows.

It is a weird thing for him to say noon, unless he's busy that morning. You may not want to assume that 9 is ok either. Good luck. --74.37.x.xx

I don't know anything about NJ, but in general, if there is a valid lease, and the lease says that the lease begins on the 28th of July without any reference to the time of commencement of the lease, then the tenant is entitled to possession of the property at 1 minute after midnight on the morning of July 28.

You can use this fact to negotiate with the landlord.
