State Specific Question About: NEW JERSEY (NJ)

Tenant filed chapter 13 Bankruptcy 9 May 2016, I got a Lawyer who said they will pay rent in June and thru the

Bankruptcy process. From June to now the Tenant has missed every requirement date filing for extensions and has not paid rent.

Our request for relief of stay has been denied, giving the Tenant until the in of August to pay June rent and it doesn’t get better.

Has anyone had a problem like this, my Lawyer says NJ is a Debtor friendly state no rights for the creditor.

If the tenant has filled for bankruptcy then all his debts are cleared. One needs to check with a landlords association to see what happened in previous cases. If the tenant is working there should be no reason that rent is not being paid. There are listings of landlords associations on this site or Google to find one near the rentals. Even as bad as the broken Landlord & Tenant act is in Ontario over time a eviction would be possible. This law should be declared unconstitutional as this interferes with ones right to earn a living. The tenant does not go to the grocery store then claims bankruptcy then walks out without paying. You can be sure he is going to be paying taxes or the government will take action. --74.220.xxx.xxx

Robert, that's a Chapter 7, this is a 13, which is a reorganization of debt.

R Jones, this is horrible! So you hired a lawyer to go into Bankruptcy court and attempt to get the relief of stay lifted and it got denied??? What did the BK court say?

What needs to be done the law needs to be changed where this inferring with one rights to earn a living. If all the rental housing providers got together then one should look at filling a class action to see where it goes. If it has to go all the way to supreme court then a decision could be made. We live in democratic countries where there are constitutional rights. If one earning wages there should be no reason why rent should not be paid. If they have filed for bankruptcy then those debts are written off. Here many times when rental housing providers got together we would challenge bad laws. There has numerous attempts for municipal governments to look at rental housing providers as cash cows. Over the years many landlords associations have challenged licensing fees which is a unfair tax on the most vulnerable the tenants. If one does nothing then there continues to be bad laws. Here the provincial government is $350 billion in debt where Ontario is already a have not province. Sooner or later the broken landlord and tenant act is going have to be changed. They will never ever have the money to build the so called non-profit rental housing pipe dream. They already said that the private sector is going to be main supplier of new rental housing. In Ontario rental housing is larger then agriculture, arts and science and aero space industries. It is 18.6 billion dollar industry which supplies good paying local jobs. With the amount of industry that has left for Mexico and other third world nations there is no the economic base to live in the past. You can not have universal Medicare care then have the government being the main supplier of rental housing. Medicare takes most of the provincial budget where the federal makes up the remaining 50 per cent. Rental housing is a economic engine for the economy that did move out to third world countries. It is more then about the extreme leftist tenancy advocate groups who are completely obvious to reality as someone said some of the chairs actually own houses. A business is the locomotive of the train which has it negatives but without the locomotive the train goes no where. It seems bad that someone profits when they fix rental buildings and houses where providing jobs and opportunities for people to earn a good living. Everyone benefits. The tenants, the area or town, the government has more tax revenue. --74.220.xxx.xx

Bankruptcy is driven by federal laws - not state laws.

Have you opened up a PACER account yet to track how they are doing with the other payment plans?
