State Specific Question About: OHIO (OH)
Asking for a friend, honest! She know I am a landlord. She rented a duplex and signed a lease agreeing to pay utilities. What she was not aware of is she is paying utilities for both units. This is really expensive, the electric bill was over $500 which is why she started investigating why. The landlord refuses to address the issue and the tenant is asking me for advice. It was never brought up that she was responsible for the other tenants and the other tenants were under the impression the landlords were paying all utilities. No, this is not one of my properties. She needs to first read her lease regarding utilities.

More then likely this was once a single family home divided up without a building permit. If one goes into the town hall then checks the property tax accessment then it may be accessed as a single family home where there never was a building permit to divide to conform to building and fire codes. It is very expensive to properly divide a house into a duplex to conform with all the building and fire codes. First all the wiring and plumbing has to replaced. There has to be one hour fire separation between the rental units. The floors have to reinforced to take additional loads of more people. Often to convert to two individual hydro electric meters the wiring has to be redone for the entire duplex. This type of rental is called non-conforming where some municipalities will not allow or close down if they find out about it. --74.220.xxx.xxx |

Is her rent considerably reduced from the other side. In other words is she being compensated some how ?
Wonder if the other tenent doesn't have water or electric how fast would the be calling the Landlord for answers and stop.paying renr ?? That would get this worked out real fast.

If the lease says "all utilities" that doesn't mean all utilities for the building, just for her unit. If there is only one meter and she is paying the utilities for both units, that would have to be clearly disclosed and should come with a rent discount. I have not explored all 88 Ohio counties from a housing court standpoint but, I can only imagine this is illegal, turn off utilities and let the landlord solve this problem somehow - this may be a mother-in-law suite your friend has moved into and not truly a double occupancy situation. --76.188.xxx.xxx |

Interesting - and very likely a sticky, illegal mess. Your friend needs to cover her interests by consulting a lawyer, pronto. It will cost her a bit, but she may recover that and the cost of 1/2 of the utilities.
The landlord is very likely running an illegal rental, though. Your friend should consider moving, especially if she is month-to-month.

I don't know about Ohio, but if this were Massachusetts, the landlord would repay the tenant 100% of the utilities that were paid since day 1. Nothing shared, not even a single light bulb on a shared porch, can be included in the electric bill for one of the units.
The landlord needs to take over the electric bill, possibly splitting the service so that each tenant can pay their own (with another meter for anything shared). --50.136.xx.xxx |
