State Specific Question About: PENNSYLVANIA (PA)

Have and employee that we provide free housing for. I am looking for a housing agreement / license agreement that if he/she is not employed any more that their Free housing ends and they have to move out within 48/72 hrs. Employee gets paid for his hours worked. --73.175.xxx.xx

On site manager. Looking for agreement that create a license agreement if he/she no longer employed that they have to move out. Trying no to make it a tenancy were by I have to Evict under tenant/landlord laws. I am sure some of the landlords on this site have live on property, property managers. --73.175.xxx.xx

IMO if you are going to do this have 2 completely separate agreements. He pays rent of X amount whether he works for you or not. His housing is not contingent on employment and employment not contingent on housing.

An exception might be if you have specific managers quarters at a complex, trailer park, mini storage or something like that. Then you would probably need a contract tied to employment.

Per IRS if you give him housing in exchange for working the value of that housing is income to him and both income and a deduction to you. So you need to consider this as well. --107.77.xx.xx

That is what it is a specific managers quarters. He gets paid above minimum wages for his hours worked. Housing is NOT in exchange for hours worked. So it should not be an issue with IRS rules.

Main concern if he/she is no longer employed, need unit back ASAP.

getting him out in a day or two will only work if he agrees. no matter what you want to call it, he is a tenant and has a tenancy.

I'd set up a month to month lease. I'd put in the rental agreement that effective the Sunday following his employment termination security deposit in the amount of $xx is due and weekly rent is due in the amount of $xxx ... that way you can start eviction quickly if he doesn't pay. Give notice to quit right away to end the lease. So you are doubling up on him - hoping he doesn't pay so you can evict for nonpayment and a notice to move pursuant to the month to month tenancy.

BE ABSOLUTELY CERTAIN TO PUT A WAIVER OF NOTICE CLAUSE IN THE LEASE. --72.70.xxx.xxx

Easier to use a standard lease, have it month to month.........pay the PM and then have them pay you. Remember you will have to w-2 (or 1099 depending on how many units managed) the PM.

If they no longer manage, then you raise rents to the point where they have to leave. I would be concerned though......a PM can cause you a great deal of grief so screen them well. --72.23.xxx.xxx

As Nicole said he is a tenant and you will have to evict. But eviction is not going to be easy, I saw someone else try similar setup and they were several years trying to get possession. Tenant does not have a monthly rent, you cannot evict for non-payment if they don't owe you rent. Lease violations i.e. not performing the work as a property manager will be hard to prove as they don't have set working hours, set work assignments to be performed during a set time period. They merely have to go through the motions to pretend to work and the judge won't feel you proved they didn't perform. You can't fire them as they are not an employee. However,you are not paying them but expecting services - the IRS will not agree with that and someday when your property manager gets upset and turns you in you may find yourself owing him back wages and the IRS back taxes. You're just going down a very bad path. --108.32.xx.xxx
