Remodeled a tear down. Took almost 1.5 months because my husband did most of the work. Didn't start to advertise until May. The renter moved in June 1st. I know everyone has heard all the excuses. I don't know or have any proof of if the tenant is lying or telling the truth because I have no proof, but an email. He emailed me on 6/16 and told me that he was in the hospital with pneumonia. I kind of felt he wasn't going be the perfect tenant. He works on commission and probably doesn't get sick leave. The rent is 1050. He only came up with 800 on July 4th. I gave him the information to deposit the rest in a checking account Tuesday morning. I was thinking of texting him either today or tomorrow on the balance. Asking for hospital proof only proves if he is lying or telling the truth. But, that will not get me the balance rent. That doesn't look good for first month and not full payment, but don't know if its bad luck for him or the usual. Please don't lecture to me about what I should have done because I know all the rules. In your opinion, if he doesn't catch up and pay the full rent for next month, start eviction right of way and get rid of him? Eviction is only $100 and takes 5 days. But, I give 5 days from the 1st to make the rent and $50. late fee. I am tired of these people that live week to week and have nothing to fall back on, but that's why they don't own anything. And these people are not the cream of the crop. I could have waited, but took a chance on him. We took other considerations. Only him and a 13 year old. He could cut the lot next to the house with the house. We live 35 miles from the house now, but moving in that area in the future. I know we are not mind readers for the future, but any ideas from your experiences? I don't need a lecture, just opinions. Thanks --70.171.xxx.xxx

I don't know. But, I have another tenant in the same area that has been paying rent coming 3 years in September this year. She is single with one child and a waitress. She wants to stay, always late on her rent, and does work hard. I don't charge her late fees because of all her situations. Only can live week to week. She knows she has to pay the 1200 rent or we will do eviction because we did it in the beginning, but she showed up and promised to pay and catch up.

I really don't want a man that cannot pay on the 5th and I am going to tell him next month will be 50 late fee if not paid by the 5th. I don't want to have another one like her. He told me that he is a grown man and will pay. LET'S SEE ABOUT THAT. He needs the house to get or keep his son. Claims ex-wife was on drugs. He gave her a inch and now she is trying to get the son. He needs to pay and not put us last. But who knows if he has attorney fees for getting son back. Not my problem. Wouldn't they need a copy of the lease? I did not give it to hi, yet. He signed 2 copies, but I was waiting until I get the balance and next months rent before giving it to him. We were rushed when he came and I did not give him a copy. --70.171.xxx.xxx

Lease is on effect even if you didn't give him his copy. You should give him his copy. Judge won't like if you didnt. If he is only $200/behind I would give him a chance, as long as he doesn't get more behind next month. You make an exception for the waitress. Also he is already in your place. I don't know what your tenant pool is like there, but I wouldn't put up with this. It doesn't really matter why he can't pay the rent -- he can't pay it, so he can't afford to live in your place. You are probably right about getting him out. This is a good time to rent and didn't want to get stuck in the winter months.

The Insurance company was forcing me to get someone in a month for the waitress house. So I let her come in, but it has been a trail of excuses why she is late. We put up with her because she has been paying. we are hoping for better days with her.

But as far as him in June house, I am not putting up with tons of excuses if he comes up with them. The house has been remodeled, but considered a cottage and not the same as the other house and that's why the rent is 1050 and not 1200. Same area, but not as nice as waitress house.

It's not easy for these people to come up with the rent, but that is no excuse. I am being a little patient with him

but he better not be lying and better try real hard to answer when I decide to text him. I really think by tomorrow, he needs the 250 ready for deposit. Just hoping he gets right.

It is hard to find good paying tenants, but I could have waited to the better person came around. Probably 1.5 to 2 months. Thought about losing maybe as much as 2100 waiting. I was hoping to start getting my money back for repairs asap. I will find out sooner or later and consider it as experience.

I am sorry, It took 1 year and 6 months to repair. 1.5 years meant to put. ALOT OF WORK AND TIME--MY HUSBANDS TIME

and money, and mine plus a lot of gasoline with trips over 35 miles. He took off from his self employment for money. Not using excuses, but that's how it went. --70.171.xxx.xxx

Yeah, I know. But that little thing about feeling sorry, if he was telling the truth, comes in and giving a chance. No excuse next month, $50 late charge. I will tell him that. The amount not paid will get the charge total amount.

I really didn't want to get the proof of the hospital stay to let the $50 go. Then he will say that I think he is lying. But hey, 3 days out sick at work needs a slip. I never stayed out sick for over 3 days and I have around 350 or so unused sick leave. --70.171.xxx.xxx

I took his information. Hate to say, his background wasn't that great. The other applicant had a dog, which I advertised no dog, worked with the other renter as waitress 2 days, plus another part time job,living in my other house, She told me she could only pay 1000. I just hated to rent to a dog owner. Her and her daughter would cut the lot, which liability was higher with the women and would move in for August. The other applicant couldn't get out of the lease with the new owner. Didn't wait to get more applicants, but was getting more. He told me that he needs the house to keep his son. Sorry - did you tell him already that you weren't charging him a late fee for July or did I miss that? If you didn't - DO IT. If you did DON'T DO THAT AGAIN :).

Stories are stories (sorry, I know you know this but I have to tell myself this all the time too). Since he paid "most" but not all so far. I would text him and ask where/when the rest will be paid (and again, if you haven't mentioned the late fee to him as of yet, include it).

If he doesn't pay when he says he's going to and/or he misses again next month - do a pay or quit notice. Don't extend this. Cut your losses as much as possible and stay out of his drama.

Empathy - not sympathy. This is a business and you have bills to pay (regardless of if you do or not - YOU DO). They (tenants) need to realize that HOUSING is FIRST. Especially since what I'm reading above is he is telling you that he needs this house for his kids (to keep them) - well - there is only one way to keep that - PAY THE RENT. --69.201.xx.xxx

Sorry Barb, but you missed one of the important rules. NEVER, NEVER sign, give, keys, lease - anything to a tenant until he pays all money up front and in full.

I learned that lesson 30 years ago when I first became a landlord.

I'm so glad that you're considering what plenty wrote. I hope that somehow, the renter is indeed is telling the truth and is in the hospital and can come up with the rent in the nick of time. However, the next time he's late, would you consider issuing a pay-or-quit notice and skip the late fee? I had a tenant would would string me along with the hope of collecting the rent and a late fee, and in the end he didn't pay up until I issued a notice. He too had tons of excuses and stories, and only a 3-day-pay-or-quit notice allowed me to cut to the chase to collect the rent.

Please do post what happens and hope so much that things work out for you especially since your husband worked so hard to renovate the place for over a year. --172.10.xxx.xxx

Just thinking. I don't think I can give the 3-day-quit notice if I collected the 800 partial payment. Isn't that correct? I will need to bug him for the money and threaten with the 50 late charge if he doesn't pay by a certain date, like this weekend. And be firm next month for August.

I did a 3-day-pay-quit notice for a partial amount several times on my late-paying tenant. I'm not sure about the laws in Louisiana, but in California, according to a known eviction attorney in the san Francisco Bay Area, you can issue a notice on Saturday or Sunday to make sure that rent is paid by Tuesday or Wednesday, respectively, or else an unlawful detainer suit can be pursued. Maybe it would save you from worrying over the weekend about whether the tenant will pay?

I meant to note that I used the advice of an eviction attorney to issue a 3-day-pay-or-quit notice for a partial payment. I first served the tenant a notice for the full amount. I received a partial payment and then returned immediately to the tenant with a new notice for the rest of the rent that was owed.

For the record, I never did hire the eviction attorney because my tenant paid the rent on the last day of the grace period each time. The eviction attorney's office gave me free documents about the unlawful detainer process. Perhaps someone from Lousiana can help you with the local laws for the UD process? --172.10.xxx.xxx

New Renter paid the $250 balance on Monday. He didn't send any text messages over the weekend about why their was no payment since he told me on Friday payment would be that weekend. My husband called him Monday and told him that he must communicate with us. He said he messed up and the check is going in that day. The tenant said he wants to stay and told my husband that he was sick. My husband firmly told him that the rent is due on the 1st. Not to make a practice of not being on the 1st. The lease says 5 days grace period. I would need to do an addendum to change it and thinking about it. Like everyone said, the 5 day grace period is a pain, because they abuse it. --

He's out. Everything was a lie.went on vacation the first week of august. He's in jail. I was right on not trusting him. Now i am trying to find out info on getting credit and background check for afuture tenant.only had one call and don't trust that one either just from a phone call. Don't want to make another mistake. He paid june and july. Face it, some people are a mess and even get worse.he lost his job from stealing.

Barb, no more, always do a credit check .Sure it costs, probably about $12 to $20. But I charge tenant $35. If they don't want to pay, it's because they won't pass it. Yeah, my husband was full time self employed. Work when you are sick, holidays, flooding, snowing in louisiana (not a normal occurence)18 degree weather because thats what you had to do. That is the only way to be successful.The guy was 40 years old and full of bull, a loser and now paying for it. Probabl had a drug problems.now since summer is ending, i have no idea how long i Will have to wait and get someone good. Having terrible weather downhere, possibly until Tuesday. No, its a long story. He was a thief, probably drugs. Stole from walmart and went to jail. And stole 3300 from his boss. Respectable neighborhood, but a scum can come out of the woodwork. Long story, but we were able to get the house back and rented for sept 1. would have still lost one month anyway.
