State Specific Question About: NEW YORK (NY)

The judge signed the warrant for evilction. I would like to allow the tenant to move out on their own. They are not answering my calls and as far as I know they are hardly there. Can I enter the premises when they are not there before I execute the warrant? As always thankyou for all your assistance. --108.14.xxx.xxx

I don't know anything about NY, but you probably have to have an admissible reason to enter and must give appropriate notice.

Why would you want to enter like that? What does that have to do with allowing the tenant to move out on their own?

I think it is called landlord execution in MO. You file with sheriff and they will put day and time they will come and landlord changes lock that time. --97.91.xxx.xxx

You have done the hard part,if you wait for the tenant to move after a couple weeks the sheriff may very well not accept the warrant to remove the tenant and you will have to start over.Do not go in,just take the warrant to the sheriff and pay the sheriff to do what they are supposed to do.By not speaking to you the tenant is signaling they are not going to move on there own. --24.25.xxx.xxx

I don't understand why you would want to go in unless you think there is an issue/emergency situation. What's the reason?

Just wait it out at this point - no need for phone calls/texts, etc. Just serve the warrant. If they are not out by that day then you go there with the Sheriff, Marshal (whoever) and yourself if you don't think they are "out". That's when you can "physically" remove them (which just means you lock them out and if they are "in" the apartment when you arrive - then that's what they are there for - to advise them to get what's needed "NOW" and get out. --69.201.xx.xxx

I do not know your state's laws or procedures. but I would probably go ahead and have the Sheriff execute the warrant, giving me possession of the property. Then, I would change the locks and control how/when the ex-tenant removes the remaining personal property.

I would also start the clock running as to abandoned personal property -- I have to store the ex-tenant's personal property for 30 days after I give notice, so I'd give notice ASAP.

Mike 45,In most of the counties in NY state where I have properties we literally put the tenants stuff on the curb with the sheriffs deputy overseeing everything,while we are doing that the neighbors are picking through it like vultures --24.25.xxx.xxx
