State Specific Question About: MASSACHUSETTS (MA)
I had a married couple move in to my 2nd floor apartment and within a year or so they were divorced. She stayed and he moved out. I told her if she ever decided to get a roommate etc. I needed that individual to fill out an application. Months went by and I started to notice a POS pickup truck parked in the driveway. Legally registered etc.as far as I could tell but junk. While showing another apartment around the same time my wife noticed a guy come out of the 2nd floor to smoke at about 2PM looking like he just got out of bed. I asked the tenant about this guy and she said yes he moved in a few weeks ago. She had him fill out an application and as I thought he put N/A under employment. Other than being stupid and moving in somebody without a job she has been a mostly good tenant. I realize this could open me up to some not so good scenarios. What if something happened between them and she moved out and he stayed? Squatter! Where do I go form here to protect my interests?

There is a movement where these working women want a house cow that does not work, so get him on the lease with a simple addendum so jointly and severally will help you collect damages, he may find a winning lottery ticket cash it they have a whirlwind fight going thru windows and walls and he would move his clothes and video game stash out making her single again with a damaged place to be fixed, but not in my watch - bill now for current damages, add him to the 2 month payment plan. --76.188.xxx.xxx |

I wouldn't put him on the lease,at this point you should still have the husband on the lease who sounds like he has a job etc,if you go changing a lease without him permission he may argue to a judge when you are suing him that because you changed the lease he can't be held responsible anymore and he may win --24.25.xxx.xxx |

Tough situation. I agree with Jeff. He moved in unauthorized, and when he did complete the app it turned out he had no employment. No income = no approval.

What is the fear? Is it that we don't want this deadbeat living on the property or that she is going to default and not pay rent? If it is #1 and her lease renewal is near or she is on a month to month, don't renew her lease. If it is #2 and you have to evict her, all you have to do is add him to the eviction. I wouldn't put him on the lease because that will give deadbeat some kind of entitlement to the property. Best case scenario is that you should have had her sign a new lease after she was divorced from her husband. Does your lease have a provision that she will be in default anyone other than who is listed on the lease lives at the property? --32.211.xxx.x |

How long was the truck there before you noticed? Tenant said he moved in a few weeks ago, but it sounds like you noticed it for longer. She obviously knew that he would not be approved. Need to know more info about current lease terms. --32.211.xxx.x |

Moshe: Married people have legal and financial obligations to each other. Shack ups do not.
A husband supporting a wife taking care of their children is not in the same category at all, as a couple of shack ups who just met and one moved the other in.
I would issue a Notice to Cure or Quit and get him out. She may go too, but that is fine. I don't want the kind of tenants who unilaterally put my units at risk like that (he could be a pedophile, thief, whatever...LL does not know). --68.39.xxx.xxx |
