State Specific Question About: NORTH CAROLINA (NC)

I have security cameras installed around my home. In the lease it states that I can have access to the footage at anytime. I told my tenant I was coming to get the footage and she has hid the security camera monitor so that we can not get access to the footage. We have been told my a neighbor that she is buying drugs on the property and we want to see if that is true. What can we do? --108.233.xxx.xxx

Thanks. I am a first time landlord so I won't be making that mistake again. I will be putting out a warrant for her arrest for larceny tomorrow if she doesn't return it by 12. I will definitely do things differently with my next tenant. Live and learn right?!? --108.233.xxx.xxx

I'm curious about this setup -- can you give more details? First, you said "around your home". You mean your RENTAL, not your HOME, right? A house?

Are they all outside? Or do you have some inside?

I think the police will call this a civil issue and tell you to take a hike.

From a legal standpoint, this might be really odd. I mean, in general, if you rent a house to someone with a security system, they get to use it. It's a bit odd to have recording hardware inside the rental that the tenant has access to and you also expect access to at will.

Also, in general, their rights extend to the house and any property that they "exclusively control." Again, you may have legal issues with forcing cameras recording on the property of a single family house.

But, to clarify, can you just give more details about exactly where these cameras are pointed? Are they all outside? Do they record into the front door, for example, even if outside?

Finally -- very curious -- do they record audio too?

Hi,

I have 8 security cameras on the outside of the rental. When we lived there we got broken in to a few times so we put cameras up. They do not point into the rental at all. The are focused on the yard, doorways ( can't see inside though) and at the buildings in the back yard. There is no audio. I spoke to a cop and I can file a police report and get a warranty out for larceny for her not handing over the monitor. It is not the best ideal place for the recording hardware to be inside the rental but all of the cameras are wired and come into the home to the recording software. The tenant actually likes having the cameras up. The only reason I requested access to the footage is because I was told my a neighbor that she is buying drugs on the property. The only other reason I would look at footage is if someone vandalized or broke into the home. Other than those 2 items, I don't care to see the footage. I stated in the lease that I can access it and they agreed to it at the time of signing the lease. She is only fighting it now because she knows she is about to get evicted. --108.233.xxx.xxx

You should ask for copies of police reports to the property, that would help you more than any footage of guests coming to visit - unless they have made a deal in the view of the camera (which has been done before at a place I service) and then you ask the prosecutor to make a copy for his/her records... --76.188.xxx.xxx

Modify the system so that the footage is dumped via an internet connection that you pay for to an offsite server. You then don't need the "monitor" to see the footage. You can access the files from where ever you want and use you own monitor at home to view the footage.

Also, I would be surprised if the tenant didn't sell the monitor to pay for their own drug habit. I would be surprised if the police do anything. Just like taking your frig, they would consider it a civil matter that should be handled with the civil courts since you have a lease on the property.

The "buying drugs on the property" thing from the neighbor just sounds weird to me. Not a lot of drug dealers deliver. :) And, if they did, they would just come up to the door and step inside (where it sounds like you don't have a camera that could see).

Is the neighbor suggesting that she's really out in her own yard buying drugs? That just seems really odd to me. Most people don't buy/sell drugs in public when their own house is right there a few feet away.

In other words, I'm not convinced that this all makes logical sense...

Thanks for the tips. I got the security hardware back from her. John, you don't know this neighborhood. They will make drug deals out in the street. That's why we moved!! Bill I am definitely going to have to look into a better system. It worked perfectly for us while we lived there but with a tenant in there now, I see how this system isn't the best idea. I'm going to figure something else out. As of now, I have the hardware so I'm going to download the footage onto a flash drive. This is the 2nd month in a row that I have had to serve the 10 day notice to pay. I read that due to that, I can give a 14 day notice to vacate for being late on the rent. I wish I had money for an attorney to help me better understand all of the processes of being a landlord. I've been reading a lot more on the landlord tenant laws for nc and I am going to order a landlord information book. I know when I get this tenant out, the next I will do a background and credit check on them before they are approved to move on and all money paid for before handing over the keys. I've learned a lot from this experience. --108.233.xxx.xxx

If you want (and you should before opening for business next time) print your local tenant laws and place into a 3ring binder, then flip the book and print state tenant laws and place in the book so no mixups occur as you read and understand the rules, drug deals in a street are not your problem however protecting your greenspace and property built there is paramount, lots of remote stuff on the market you can grab wireless footage and store at the office, you can contact detectives and share the IP address to help them. --76.188.xxx.xxx
