State Specific Question About: FLORIDA (FL)

Tenant just called, told me that "I am Evil, evil, the most disgusting person he ever met..." I hung up.

Long story, when he checked out June 4th, 2016, he gave me no forwarding address, just asked to call and he will pickup the deposit but wanted to leave the pots in the backyard for pickup later, (along with lots of trash) I did say O.k. but I just wanted to get them out. So I promptly put everything on the curb. Four days later he called, mad his pots were gone. They always wanted more, Chris the ceiling fans make too much noise, I can't sleep. Chris the toilets seats are dirty. So I replaced all with new, then it's Chris, the toilets make funny noises, so I replaced them too. Then replaced the rubber strip on the garage door because he found a dead snake in the garage. I really was happy when they called and told me they were going. And all they did when they left was shampoo the carpet, left dust, dirt, mold in the bath.

It was a long 15 months and this Saturday I'll give them their deposit back but now with the phone cursing, this is a first for me. I did mail them their deposit, "last know address", it's on its way back to me undeliverable. Sat is 30 days, I am going to take a cleaning fee $350 and give him back 650, I just don't need to get into a fight ya know.

Did you take plenty of pictures of the condition of the rental unit after move out to justify the cleaning fee just in case this tenant decides to sue over not receiving all their deposit?

Give him what his deposit is and move on. Next time, don't be so accommodating to the tenant's requests. If someone complains, you check it out. But unless the ceiling fan is unoperable or dangerous, I wouldn't change it. It sets a precedence that you are going to swoop in and fix anything they don't like. Unless you are a luxury market landlord, I wouldn't even bother with these items. If something is noisy, etc, I tell them I will check it out on my next maintenance check of the place. Most times they never ask about it again because it wasn't a real issue. --174.70.xxx.x

Now, you are complaining that they don't think highly of you. I don't know if "evil" is a serious epithet, but you made a deal, and then broke it without a second though. If not "evil", what should they call you? A Florida giver?

You need to have an accounting of the cleaning costs, this is deducted from the damage deposit, save the photos for court but make a note of them in the accounting statement. Stuff left is only left till next trash day. --76.188.xxx.xxx

I would have been mad too, you gave permission and threw out his stuff, as stated before fixing problems is one thing but jumping through hoops over non emergencies is another, you sent the accounting by law and have proof, get an address to send him his money and tell him straight up this is what he is getting and why. Thank you to all, it is what it is..., I am also a retired Senior Chief and document document document wins everyday of the week.

In the end, the lease spells it out quite clearly and we/I make it long signing process and have them initial every page, and the move in move out insp log, signed again. I have been to small claims court a couple times and with documentation it's cut and dry and I've never lost, that does not mean I've collected oh contraire, however, this is another live and learn, education is never free, be it formal or the school of hard knocks.

Life is a long road, I am in no hurry to get there. Happy 4th to all. --138.162.x.xx
