State Specific Question About: MASSACHUSETTS (MA)

I have a lease in force with an international company. The lease is due to expire Aug 31. The tenants have been excellent (they are on the 2nd year) up to this point. The rent has been paid on time for the most part via a wire transfer directly into my bank account. June rent has not been paid as of June 15. When I asked the tenant about the rent, he informed me that the company is in trouble and they are in the process of liquidating. I did not collect a last months rent as a courtesy. He now informs me they they are planning to move out earlier and recommends me to use the security deposit for June. The tenant is the CEO/founder of the company so I know he knows exactly the company's position and controls assets. I feel like I am going to be scammed out of remaining rent. What are my options at this point? What are recommendations? --152.122.x.x

I'd ask them for a solid move out date, like June 18th and if not out I'd file for eviction of nonpayment of rent on Monday June 20th. I'd work with them to get them out quickly and honestly. --173.108.xxx.xx

OK I spoke to him today and he was very apologetic. He has a move out day of June 29th which I don't doubt because he wants to get his family home. I did notice from his company website he went from CEO to CCO, not sure if that validates his story or not. He told me he has barely enough money to get home. He offered to write an email to the CFO on my behalf (stay tuned) the question is do I have any recourse with this company operating outside of US or is it a waste of legal resources? I have a feeling the consensus will be to cut my losses and be happy he is moving out and on to the next.... --152.122.x.x

Does the company have any assets in the US? If so pursue a small claims action against them for damages if you can. You may not collect it immediately but you never know what might happen down the road. If they were doing business in MA they should be registered with the secretary of state's office and have a registered agent for process service. --166.137.xxx.xx

Stephen, If I were you I'd try and get the place ready for the next tenant and hope it's in pretty good shape,which it probably is, just be glad you met them, If the Economy hadn't tanked ,they could have been there for years . Keep in touch with them,someday you may want to take ten days or more off the regular grind and visit their home country,Its nice to have a base to operate from especially if there is a bit of a language problem! Sounds like you may have a blood from turnip problem.

Have you been inside recently?

Since they know they are stiffing you out of a month's rent, ask them to work with you on finding a new tenant. Get out the move out checklist and go over it with them.

Ask them to get it totally clean. Hire a cleaner if needed.

Then start making ready to show it off to find a new tenant. --64.251.xxx.xxx
