State Specific Question About: CALIFORNIA (CA)

I build a wood fence between our houses 15 years ago new owners have been there six years and I want to tear down the wooden fence and replace it with new chain-link fence they're saying that I cannot tear the wooden fence down. Need answers. --107.206.xx.xxx

You can do whatever you want with it, it's your fence.

Sounds like they want to keep the privacy it gives. Maybe they'd share the cost to replace it with another wooden fence. If not, do your chain link. If they want privacy they are welcome to install their own fence in front of it.

I've had many fence issues over the years. Even though you may follow your local laws, had a survey done and owned the fence because it sat on your side of the property line -- the way you deal with your neighbors is just as important.

One time I had an issue with a neighbor on a rental property of mine. I drew up a document and had the neighbor sign it.

Then 12 years later another issue arose and again I had documents showing how things were resolved.

Then another 7 years passed and the neighbors removed my plants, torn down part of the fence and then put their property up for sale.

Since the neighbors were into their 80's, the law forgave their mental state and lack of memory. But I had documented proof they lied and damaged my property.

So I placed a lien on their property and sued their insurance company, son (manager of their affairs) and the neighbors. I could prove the neighbors did as they pleased at my expense and tired to take no blame. Since their insurance covered liability issues, I asked to be compensated without going to trial. I also asked for the case to be arbitrated. And there I won.

If the fence is on your side of the line, you can do what you want. Having said that, nothing says "ghetto" like a chain link fence. Chain link fences are for prisons and industrial buildings. Have a little pride and put something better on your property. --68.156.xx.xx

Are you wanting to replace the wooden fence because it has deteriorated? If so, ask the neighbors to split the cost of a new wooden fence with you. Then it will look nice for all and be cheaper for you. --64.251.xxx.xxx

Chain link fences last much longer and tenants are happy for a fence to contain their children and animals. I can understand wanting one over wood in my area.

I tend to stick with the costlier higher maintenance shorter lifespan wood because everyone orders the privacy of wood when they're not paying for it but you have to do what makes the most sense for you.

I'd be less inclined to work with a bully neighbor. --65.35.xx.xxx
