State Specific Question About: TEXAS (TX)

Rented a small duplex 2 months ago. My water bill was 80 the first month( looking back at bill that was 1 week bill) the 2nd month I received a 380 bill. I called the water co and found out I have a leak. I notified my landlord that day, a week later he tore out my floor and found a few leaks under the house. He informed me the house had been empty for a year. The water co refused to discount the bill. My landlord refused any assistance. My water was cut off because I could not pay that amount, I called my city manager to find out if I had any legal options. She called my landlord and told him to evict me becuz I have no water. My landlord told me he is filing eviction because "I made waves with the city" my court date is the 16th I have 2 special needs kids and no where to go. What can I do? --208.64.xx.x

The water dept should give you a break, if you can show the repair has been made. The landlord acted quickly, once he found out of the leak. Did you not notice any soggy ground around the premiter of the house? Didn't you notice soggy carpet? What city are you in? --96.226.xxx.x

Ask the landlord to reconsider. It would seem to me they should cover the water bills minus normal usage for your size family . Did they not have water turned on previously? Like we when they were working in the property? Ask the water company --66.87.xx.xxx

Homer (TX), this LL was supposed to find those leaks at least 3 months ago, not when he was ready to dump his problem on the renter. What responsible person keep the water tuned off until the dwelling is rented. Look like retaliation against the renter by filling for eviction if it is as described by the tenant.

Patttyk (MO), you are correct. This LL should make it right by paying the bill, less normal consumption.This is what I will do in a similar situation.

I didn't see the part that said the water had not been on. Surly he had the water on when he was getting it ready to rent? Jill, why don't you ask the water company for a history report? That may help you in court to prove the water had been off an extended amount of time, so you shouldn't be liable for the leak. One of the cities I rent in require city inspections before rental. If the water was "used" and went through the meter......its gone and the water company can't get it back so you aren't getting any help there. The sewer authority might be able to assist you if the water went into a drain that wasn't attached to the sewer system.

I am in White settlement, I will ask the water company to give me a history report. I received notice yesterday we go to crt on the 16th I have called legal aid and am waiting on a call back appt. It has been raining her for the past month or so all the lakes are full. I did not notice any water around the house but with all the rain I wouldn't have thought anything off it. My carpets and floors have not been wet. No water came inside the house. As for the comment about needing to live with family. My husband passed away 6 months ago. I have no family. I am an only child and my parents are deceased. His family do not live in the states. There is no reason a strong single mom can not live on her own I do not need anyone to take care of me I only need the LL to do the right thing. --208.64.xx.x

Jill(TX), you're in a tough situation - the stress from losing a husband, moving, and parenting two special needs kids must be difficult. Please realize that this is a landlord forum, and while the advice is good, we're better at telling each other how to handle difficult tenants and fix water heaters. There are tenant forums, if you use Google you'll probably find them easily.

The advice given here to pursue some legal aid is good, and I hope they can help you out. If you're at all connected with a local church, see if they might be able to assist you a bit financially to enable you to move on from this undesirable rental situation. If not, contact your local social services to see what help they can give until you can move past this tough patch. (I checked on your location, as I have a cousin in TX with a heart of gold who also works for a large church, but she's near Dallas, so that won't help you.)

Strong women still sometimes need someone to lean on, and there are some good folks out there who have organizations in place to do just that for you, temporarily, so you can be strong for your kids. I hope things improve for you soon. --71.175.xxx.xxx
