State Specific Question About: ILLINOIS (IL)

This almost happened and I would like feedback. Tenant was on his last month of lease. He was going to use the security deposit for final month. Lease forbids that. He was behind on water bill (which property owner is ultimately responsible for). He could have left us with that water bill, ignored the $250 penalty for using the security deposit, and left us to pay for any damages. Since it was his last month, there would have been no use in serving eviction notice as that would take time and cost money.

Question: How would other landlords have handled this situation? He could have lived there the last month basically free and continued to use the utilities. --67.163.xx.xxx

This is sooo common.

You get what you allow. So don't allow this by delivering a DEFAULT or LATE LETTER. (we send a text). No payment? File in court.

Nothing will happen until he believes you will take legal action.

Same as those before me, be sure to add the late/legal/court fees onto the actual rent when payoff discussions begin, the court will sort it out - best to serve with -zero tolerance-, you have the address to get it served fast, sitting on your hands only amplifies the delay. --76.188.xxx.xxx

I've had them try this. Simply said, 'In IL you have 5 days. You are free to move out in that 5 days".

Otherwise, serve the 5 day and file. Tell them it will show that you filed against them, even if it did not go all the way to eviction. And other landlords will see that. --75.132.xxx.xx

I'm questioning the $250 fee for using the SD as rent? That wouldn't fly here - the Security Deposit is for damages (financial or otherwise) not arbitrary fees.

A fee for not paying rent would be limited to the legal late fee of 5% of the rent, charged once per month.

So filing for eviction for breach of lease - the breach is failure to pay rent - would be our only recourse.

And that costs about $150 here.

I make sure to explain to a resident on the way IN that I do not "legally have access" to the Security Deposit until they vacate the premises, as it is not co-mingled with personal or business funds but is held separately by law for THEIR safety, to ensure it's there to return when they move. --173.22.xx.xx
