State Specific Question About: CALIFORNIA (CA)

I have a single tenant that is asking to allow his son to stay in the unit for four months. The rental agreement calls for a rent increase of $100 per additional person / per month. Would like have the guest sign an agreement stating they are only guests and not a tenant. Is this enforceable since they will be paying the additional $100 rent. Any suggestions on the format of the agreement would be appreciated. The unit is under the Los Angeles Rent Control ordinance. --71.243.xxx.x

I would never charge for a guest. It's only water for Pete's sake although I know you have water issues out there. Someone needs to fund a canal project from the northwest. If they can pipe oil they can pipe water. Keep nickel and diming tenants and they leave. I keep them for fifteen years or until they die and that means I don't have months of no rent due to empty apartment and all that repainting and danger of having a tester coming in and getting in trouble. --73.33.xxx.xxx

Check the local ordinance to see what is in it. How old is the son? Will he me helping elderly tenant, or is he young and and needs a place to stay while he finds another? Or is he just visiting from out of town. Now maybe you don't want to have another person staying there, and if it turns into too long, you might have to add him to the lease and raise the rent at renewal.

The way I see it, if they are paying an extra $100 rent, then they are tenants paying rent, even if only a tenant for 4 months. They are not guests. Like AllyM, I do not charge for significant others staying, in NY family members can stay anyway. The rent is based on the unit, not the number of people. (of course I may find a way to deny a lot of people) If the water is so expensive that you can't afford it, maybe just add an additional water charge. Remember a lease is an agreement between 2 parties, that can change if both parties agree. --100.4.xxx.xxx

It all depends on how good the current tenant is, and how much you want to keep him. If's he is an excellent tenant: cooperative, pays on time, takes good care of the place - then I would work something out to cover the increased utility usage (if you pay for it) and the additional wear-and-tear. Only you can say whether the $100 is too little, too much, or about right.

If the tenant is marginal, then enforce that lease clause without discussion, and maybe he and his son will go elsewhere. If I understand CA correctly, you'd then be able to bring someone in at market rent, a win for you. --71.175.xxx.xxx

Tenant is elderly and his son is an adult. Son is looking to move him to an assisted living unit but since his father is on section 8 assistance, he is having difficulty finding a location. Would not like to have any issues of the son saying he can stay in the unit if his father vacates. --71.104.xx.xxx
