State Specific Question About: PENNSYLVANIA (PA)

When it comes to renting an apartment are there any rules or laws regarding service dogs..? Can you deny a service dog..? We have a unit listed and stated "No Pets" in the ad but I have someone asking about a service dog.

A service dog is a trained dog that has a certificate like a Guide Dog for a blind person. Some people claim that they need emotional support animals and have no certificates because there are none at this time. Others will post with more information and their experiences. I take cats and small dogs because I get more good applicants and they stay forever or ten or fifteen years or until they die. --73.33.xxx.xxx

A single family house is completely different from a rental complex. Have had many problems with dogs. First they leave the rental unit then the dog starts to bark. They use the balcony then never take the dog out for a walk. After two to six months the carpet, hardwood flooring in the rental unit is completely destroy then they move out after the rental unit is completely trashed out. In Ontario it is illegal to charge a cleaning, damage or pet deposit which encourages people not to take good care of rental units. The best option is say make the rental unit pet friendly. Say three hundred more per month then all carpeting, hardwood flooring is replace ceramic or porcelain then they will tell it is not worthwhile. A rental unit is not Buckingham Place where around 350 servants look after the palace where cleaning up after the dogs is no problem. --74.220.xxx.xxx

Iam beginning to think that every landlord group needs to have a class from fair housing on these various critters and the methods of proving legit, one thing is certain the owners must be able to maintain them using voice commands or they have not completed training, also damages must be added to next rent cycle and the maintenance of these tenants can easily climb up with the repair bills. Be certain you understand your local and state tenant laws and have experienced several months of housing court sessions so you know the behavior of the court staff under pressure of the -BS meter- they have just out of view, legal costs are by most expensive hourly labor in the whole business. --76.188.xxx.xxx

Just to be safe so that you don't make a mistake and ask for something that you shouldn't... AllyM is incorrect. Service Dogs are not required to have any "certificate" like she mentions -- and asking for one to show proof is likely to be a Fair Housing violation.

She is correct that there are "Service Animals" (which are trained to perform a task for a disabled person) and there are "Emotional Support Animals" (which are not trained, but still are supposed to exist to provide an improved quality of life for a disabled person). When it comes to Landlords, both fall under the Fair Housing Act, not the ADA, in most cases.

As others have said, we've had lots of threads on this. Do some searching and reading. Long story short: they are not pets -- so any "no pets" rules do not apply to them.

I just got one who has a German Shepherd service animal...but he says the animal "may be relinquished for medical reasons"...I don't know what that means...I guess I'll find out at the showing tomorrow. --72.188.xxx.xxx

I've decided to "open my mind" to the whole ESA issue...as ridiculous as I still think it is, and an entitlement mentality issue too. As John(MI) said on a different thread it is not worth the huge fines if you get caught discriminating against them.

But having said that if there is something else on the application that I can legally reject them for I will--I would rather not have a pitbull in my unit if I have a choice.

Remember that it is our duty to make reasonable accommodation for tenants with service/ESA animals. However they in turn are still responsible for ensuring that the animal is not creating a nuisance or causing damage to our properties. Have an addendum signed with your criteria . Constant barking, cleaning waste messing inside home etc. The mear act of of committing their pet to good behavior is often enough to deter them from renting. --73.181.xxx.xx
