State Specific Question About: WISCONSIN (WI)

I have a friend that has a one bedroom apartment. A lady, who is mentally disabled, has applied. She has an attendent who checks on her. I have called her previous landlord and he wouldn't rent to her again,. He says he will have to replace the carpet because she watches tv and eats and doesn't clean up after herself. There are also cockroaches that she has brought in. My friend doesn't want to rent to her either. How can she tell her that she doesn't want to rent to her and not get in trouble for not renting to a disabled person? The apartment is in a small town, so my friend can't tell her it's already rented. She could drive by and see that it isn't.. --207.118.xxx.xx

That message screams future issues.

Molly,

No need to lie or make up excuses.

Of our applicants few call to follow up.

If they do call our response is designed to deflect arguments and protect the LL who gave the reference.

"Thank you for applying. We're sorry, your application did not check out. Best of luck in your search."

If they press for more info we respond "You are welcome to mail a written request for more information." Cannot remember the last written request.

The social worker knows why.

We USED to tell them "bad references" but that just led to arguments about how their LL was a slumlord and we should not believe him/her. Also learned a lesson when a LL called us back and complained he had told us that info in confidence.

Reminder: if you pulled a credit report send THE LETTER to CYA.

My tip: Applicant must be EMPLOYED. We do not accept SSI or disability because we cannot garnish if they fall behind or get any extra money for cleaning and repairs when they leave.

Brad, how would they know WHO gave the bad reference? I also think that the whole garnish thing would be state specific and court specific, lots of loop holes out there for folks to take advantage of, at least in my state!! --71.1.xx.xxx

Great question! The application asks for current and previous landlord. It's not hard for them to figure out who gave it a bad reference – either their current landlord or their previous landlord.

We don't bother with any other references such as pastor, good friend, former boss because these people don't have financial information on the applicant and usually just say something like he's a great person.

Locally most of the large apartment complex is will not give out any references for fear of legal retaliation. Many private landlords have now adopted the same policy – they won't tell us anything for fear of a lawsuit or slashed tires.

My judge says it's federal law that he cannot order garnishment or even write down an abreed payment plan for SSI or disability income. Yes there are clever ways around some of this for advanced landlords. Education is power and profit. --73.146.xxx.xxx

the way around this is you don't garnish their income, you garnish their bank account. As long as even $1 gets deposited into that account that isn't their ss check, you are okay. Know for certain that you are right because on the 4th of the month when they have a frozen account they will be in to legal aide for assistance. --72.95.xx.xxx

I would send a letter "Unsatisfactory Landlord Recommendation".

One of my pre-screening questions ask "What kind of recommendation do you think your current LL would give you?" On the Application I request current and previous LL contact info. Therefore a valid reason the not approve an applicant. --205.223.xxx.xx
