State Specific Question About: CALIFORNIA (CA)

My tenant is complaining about mice in the unit.

4 unit in a complex of 4 unit buildings, 48 unites total.

I told them it is normally the tenant problem.

What does CA law say??

Is it "more than 4" its my (landlord) problem or "4 or more" is the landlord problem??

Not sure?

I doubt it is the tenants problem by law but either way take care of it or the tenant will probably move out,most tenants don't know what to do.Just go set a bunch of traps in the apartment and the basement and get rid of them in 1-2 days --24.92.xx.xx

I'd ask the tenant whether they have any pets. If not, then I'd suggest poison packets and glueboards behind appliances. In basement, I'd use poison packets and spring traps, with generic peanut butter to use as bait. Expect to catch a quantity between 5-10 of them over a period of 20 days. --66.87.xx.xxx

It can sometimes be difficult to spot the entry holes. They can be no larger than the perimeter of a dime. My clues have been the wall soot that forms around the hole edge. --66.87.xx.xxx

I used to operate a pest control ship for someone, so I know ... mice and rats both have have a high metabolism, so they must constantly drink and feed. If they cannot find a reliable food source within 24 hours, they will die of starvation. --66.87.xx.xxx

I would inspect their apartment. Make sure it's clean. If it's not - then advise them they have to clean it or any attempt you make is pretty pointless.

What floor are they on? If they are above people - they most likely have issues too ... if they are on the first floor or above a basement, then this may be the stopping point before they move on.

I would go to Farm and Tractor (or local hardware store - Lowe's, etc) and get the bait BLOCKS (not the packets). I am suggesting Farm and Tractor only because you can buy a bucket of them instead of the measly 18 pack at Lowe's, etc.

Put them EVERYWHERE in the basement. You can also put them behind stoves, fridge, etc. If there are pets and/or children (small ones that will put things in their mouths) then make sure you get the containers to put the blocks in so they can't just pick them up and eat them.

The blocks will help (not a guarantee) to have the mice/rats EAT them right there (they are too big for them to just stuff them in their mouths like the pellets can) and they start hemorrhaging. They think they are thirsty so the "hope" is that they will go outside to find water (make sure you don't have any water available inside). So once they are outside - they will die outside.

They may die inside so go there every few days to check. You will also see that they are chewing the blocks.

Thank you all for the answers, the sticky strips have worked for me in the past and I really want to keep the young lady, she is air force and quiet and pretty clean. The mice came in when she was TDY so I will help her to get rid of them, oh yea, no basement, just 2 floors each unit, 4 units to a building. Sticky strips. --75.83.xx.xxx

The only problem with glueboards is that

If you had this issue in a SFH, I would tell the tenant that it was their issue....but seeing that this is a MFH situation, this will end up resting on your shoulders. You will not know for sure whose home they are coming into originally.

My lease puts this on the resident.

BUT...

in real life I'm with Ken. They will move out. My judge will let the res out fo the lease if the LL cannot prove he responded properly.

Go inspect, looking for food, trash, entry points to seal up...

always a problem with many people in a close area.

It's really easy and inexpensive to treat. Be a hero to them while keeping your property pest free.

Your building will get a reputation for having RATS making ti hard to rent in the future.

I agree. An immediate response by inspecting the premises, making helpful suggestions about cleanliness (should grease or food be an issue), and proper pest control is a relatively cheap tenant - retentive policy. It also holds you in a higher regard with the tenant, who will be more inclined to work with you on any future rental issues. --66.87.xx.xxx

I have SFH and my lease puts it on the Tenant. HOWEVER, if a tenant mentions it or expresses a concern, I send the Maintenance man(hubby) to take care of the problem. Look for pest entry, put out traps &/or poison and check to make sure the unwanted visitors have nothing to do with lifestyle. Customer service goes a long way and traps/poison are pretty cheap. --205.223.xxx.xx
