State Specific Question About: VIRGINIA (VA)

I got a rental application without a SSN. They put ITIN and they are filling taxes and their income is also more than 100K. They told me they don't have any VISA but they have drivers license ,back accounts and kids got SSN too.

My question is: Is it legal to rent a property an illegal immigrant in state of VA.

Please advice.

Maybe I'm being stupid on this but what's "ITIN" mean? How do you know they are illegal? Did they tell you?

I can't imagine they would tell you ... from what I "know" some actually do use SS numbers, pay taxes (employment), etc - that's another reason why the US won't really get rid of them - they are paying taxes into a program that they will not ever be able to get paid back from.

The question is do they have a valid green card. Anyone can live in the Us as long as they are not employed but when employed everything changes. Here they get 900 series social insurance number until they become a citizen. One case they took the children out of school so they could deport the entire family. Most of these people have to work as there is no social assistance for them. There are always two ways of looking at things. On the one hand they are illegal in the country on the other hand they are working not into criminal activity. Often even though the economy does not have a lot of jobs this is still a first world country where things here are much better then a lot of other countries. --74.220.xxx.xx

The applicant can get copies of their previous tax forms (transcripts) from the govt to attempt to match up their itin, current/previous addresses, and income.

I'm sure to ask if you are a citizen or similar question is not a good thing.

If they don't have credit, you reject like any other applicant. if they lie, you reject like any other applicant.

I don't want to know where they are from so don't tell me. But I will tell you that if they are from somewhere that troublesome people come from, like ISIS people, you need to be really careful or your rental could become a crime scene. I once had an applicant who when asked for her ID, simply replied that it was taken when her purse was stolen and hadn't yet gone about to replace it. She produced a U.S. passport instead and verbally stated her SSN. When I ran the credit report, it stated that the SSN was assigned to someone residing in Grand Rapids, MI. When I confronted her with this information, she quickly changed her mind about wanting the apartment. With my naiveté at the time, I never came up with the thought that she was, in fact, an illegal immigrant. With all of the assumed identity scams now occurring, I am more careful and thorough with my background checks. --66.87.xx.xxx

BTW, we rent to a lot of illegal Mexican men. They pay on time every time and don't complain. I don't even know who lives in the houses any more because they just rotate thru. Each house has been occupied for years.

Brad, well if you don't know who is residing inside those specific rentals, then what happens when the rent isn't paid on time? On your Pay or Quit notice, do you just list the original tenants' names? Also, do you have a "Unknown Occupant" listing like we have here in Illinois? What do you do when any utilities go unpaid?
