State Specific Question About: VIRGINIA (VA)
I got a rental application without a SSN. They put ITIN and they are filling taxes and their income is also more than 100K. They told me they don't have any VISA but they have drivers license ,back accounts and kids got SSN too.
My question is: Is it legal to rent a property an illegal immigrant in state of VA.
Please advice.

They must have a TIN if no social, best to keep on taking applications - a couple years ago I took in a lot of app fees for stuff like this, it cost less to be empty than a bad tenant you cant get out. --76.188.xxx.xxx |

(Virginia law aside)
By Federal law you cannot ask if they are a citizen.
You cannot discriminate against them if they are not a citizen. (NATIONALITY is a protected class)
BUT you CAN require a SS# in your criteria for identification purposes.
The only reason I need a SS# is to run a credit check. The ITIN works for everything else.
Be sure to do an in-home inspection!! Some folks from other cultures have a very different concept of "clean"!

Brad--Nationality (whether a US citizen or not)is NOT a protected class, national origin is. You can discriminate against illegal immigrants. (Where legal residents who are not citizens stand in this issue I don't know). The problem landlords run into is that they only ask the citizen questions of certain ethnic groups, and that is illegal discrimination. So, if Juan Martinez that only speaks Spanish wants to rent your place and you ask about his immigration status, you had better ask the same question of John Smith that applies speaking perfect English.
