State Specific Question About: CALIFORNIA (CA)

I found out that my renters got arrested for credit card fraud. I listed the house for sale. They are applying with other landlords. Getting calls from them. If they ask if they have any criminal records that I am aware of, i choose to decline. To some I say that I usually to both credit back gound and criminal they all say we only do credit back ground check. Any suggestions? --107.77.xx.xx

You shouldn't be telling people about any arrest. How long did they live there? Did they pay on time? Did they follow the rules? Did they cause any problems? Did they get their deposit back? Are they being evicted? Would you rent to them again? These are reasonable questions that you could answer. Don't talk about their personal lives unless the crime involved you. --24.94.x.xx

That's weird that some other LL would ask you about a tenant's criminal history--it's the landlord's job to do a criminal search on their own on the computer.

If our roles were switched, I'd want the other LL to tell ME any negative information. So I'd say something like, "I only have direct experience with them as a tenant, but I would STRONGLY suggest you check online criminal records with the county." I could see someone asking the former LL if there were any police calls to the unit while those tenants were living there for disturbances...but anything beyond that...asking about their criminal record seems kind of weird...kind of like asking about someone's credit report which I would never give out information on. --72.188.xxx.xxx

To clarify, you found out that they were arrested LONG AGO for it? Were they convicted? Or do you mean that, while they were tenants, you found out that they were JUST RECENTLY arrested for it and are about to go through the court system?

Sometimes, an "arrest" is different than a conviction.

Also, California is often odd about such things. Are you allowed to disclose arrest (that isn't a conviction) information there? I know that seems weird, but I've been surprised about CA before! :)

Sounds like the other landlords are being cheap, say nothing about the criminal stuff, I don't think you can disclose this, it is up to them to do their own screening, just the facts rent paid on time yes/no. --71.1.xx.xx

It would be strange for a LL to ask the previous LL about criminal history. If I were asked that, I would not provide an answer.
