State Specific Question About: PENNSYLVANIA (PA)

We have a rental .Tenant owes back rent. The water bill is in our name,because it follows the property owner. Why legally can't I have it shut off after the eviction date. It's like the tenant has more rights then the landlord!!! Any advice? --72.23.xx.xxx

In PA the eviction is a three step process.

After the final step, the lock out - you are allowed to shut off the water.

I have already served the eviction notice in which is up on Friday the 8th. Now I have to go file with the district Magistrate. I can't think about selling until this nightmare is over. We leave in backyard and it has been a nightmare. We are about 60 miles south east of Erie. My point was tenants have more rights then landlords do. I actually feel, after reading others on this site, that Pennsylvania is fairly landlord friendly.

YOU messed up by not having a proper PENNSYLVANIA based lease if you needed to serve them with notice prior going to the magistrate.

File Monday morning at 8:00 a.m. so that the constable posts the property on Monday. Request a 7 day hearing (your magistrate may or may not do that). No matter, after your hearing, file for possession at 8:00 a.m. on day 11. In other words, be proactive from here on out and they'll be out in approx. 30 days.

Personally, if I really wanted them gone, I'd pay them. If they go through the entire process and don't remove their possessions, you then need to deal with that (and them) for another 10-30 days --72.95.xx.xxx

In my opinion the tenants have more rights in Pennsylvania then the landlords. We have rented this property for 20 + years and went by the book,and it always turns out the same we always end up loosing lease or no lease! Just wanted to hit them were it hurts. They will just get a judgement against them and we will still be out a bunch of money

That place is in my backyard as I my investing in Mercer and Crawford Counties. If you need assistance, just yell.

Don't let the tenant get you stirred up. It is your job to stay in control and its their job to try and dodge responsibility. You simply can not let them do what they want to do.

Its not personal......if I could somehow wave a magic wand and not pay my bills without much recourse - I would try it too. But I am too honest not to pay my bills, your tenant just isn't there.

After you file at the DJ office, a hearing will be scheduled between 7-10 days. The hearing is part one, part 2 occurs 11 days after that hearing when you request the writ of possession, and then part three occurs at the lock out. AT the lock out, you can secure the water.

Indeed the process seems unfair. It is what is it is. You have to follow the process. Not all DJs are the same in style or views on the process. Any idea who you have? --24.154.xx.xxx

Kelly, something that new landlords get wrapped up in is the tenant drama, try very hard to ignore the drama and move forward to file the eviction - no reward for sitting on your hands, print out a copy of your state and local tenant laws - this will help you form a better lease plus the folks here are very helpful unless your local rules are unfamiliar.

Ray it sounds like you guys are in the backyard of my farming work from Greenville west to Mecca, I live near the Cleveland airport but try to get out to the fresh air at least once a month stopping at the diner in West Mecca for some telephone signal and soup before going eastward to work. --76.188.xxx.xxx

Kelly, you're right--the way that water bills remain with the property owner, rather than the tenant, is unfair.

The best you can do is mitigate the damage. Get the tenant out ASAP.

Going forward, what helped me (after being stuck with a $750 water bill) was to include water IN THE LEASE. My lease states the rent due and then an additional $XX amount for the water/sewer/trash bill. It also states that the tenant is responsible for any charges in excess of $XX. Then I pay the water bill myself.

Since my lease states that the water bill is part of the rent, failure to pay the water bill means I can immediately move forward with eviction. Once the water bill is folded into the rent, it gets paid. I haven't had a single problem since. --71.72.xx.xxx

Do not assume that water bills are lienable. I made that mistake when I first started out and got hit hard on water usage. Turns out that it varies town by town. Ask your supplier first. If not, then let the tenant pay the water. --70.199.x.x

I do what Robin does - I have the water (for those properties that are separate meter or SFH) in the lease indicating that it is the Tenant's responsibility to pay. It's called "added rent". I KEEP THE BILL IN MY NAME AND I PAY IT THOUGH (this way, I know it was paid - by me). If they do not pay ME though - it's considered rent NOT paid - so I can then start proceedings to evict, etc.

I had one tenant in a SFH bring that up (we were in court because she stopped paying rent - her "monthly" rent - among a few other things). She disputed the amount (of course) because of blah,blah,blah but also added "water/sewer". The judge looked at me and said "thoughts?".

I said "judge, it's here in the lease that they are responsible for the water/sewer...." He turned and said "is this your signature"? "yes" ... "awarded".

If the water company is run by a municipality then they are lien-able in Pa. Some communities out source the management of the water company's. That might put a kink into the lien process.
