State Specific Question About: OHIO (OH)

I have a tenant who installed place n' press vinyl tile over an Armstrong sheet vinyl floor without written permission (in Lease no changes made without written permission). What can I deduct from their deposit; the whole repair of removing and replacing the place n' press tile; just the removal or none of it? The contractor said that most likely the original flooring is damaged. --208.102.xx.xx

If it's just place n' press tile - are you sure the original floor is ruined? Was it the "good stuff" or the real cheapo stuff?

So many people put that real cheap stuff over other flooring and it just comes right back off and doesn't actually stick. If that's the case I would think that you could (maybe) just get some good cleaner and get the rest of that sticky stuff off.

I don't know - that's a good question. I had a tenant do it to a laminate floor I had but the laminate was bad (it doesn't look any better now because they just put it over the bad and don't really install it properly).

Once they move (if they do) - I'll probably just replace the floor since it needs it. --69.201.xx.xxx

You can deduct the cost of removing the peel-and-stick. You can deduct the cost of cleaning the vinyl underneath.

How old was the vinyl underneath? If it was brand new and the tenant destroyed it, then you can charge for new flooring. If it was 10 years old a judge could rule that it was past its life expectancy and had no value. --24.106.xxx.xxx

You are making a "repair" due to the unauthorized actions of this tenant, this has nothing whatsoever to do with useful life of your old vinyl. You can't replace it with 78% useful life vinyl, you will be forced to buy new vinyl. Even if there were a reason to perform this depreciation exercise,

Charges for removal of tiles, your damaged vinyl, and replacement with new vinyl are all expenses that you will now be making; Expenses that you otherwise would not have incurred had tenant not taken the actions that he did.....why shouldn't he pay all that it takes to make you whole? --72.172.xxx.xx
