State Specific Question About: PENNSYLVANIA (PA) Tenant did not give any notice that they were moving. Found out myself by chance on 2nd of month (luckily). There are some damages I will be deducting for but can I charge any rent since I did not get a 30-day notice of termination of lease (month-to-month)

My lease is clear: resident agreed to

-30 day notice required so yes I would be charging for that.

-Early Release Fee (a number which is double the rent)

My court allows this.

If they left in March, they owe March and April. But, you have to mitigate damages, which means finding a new tenant. Once you get a new tenant in, reduce the rent balance for the days the new tenant will be paying for.

In Pa we are not allowed to double collect on the unit. Meaning, if you charge her for not giving you a 30 day notice, you will not be able to rent it out during that 30 day period. If you would rent it out, you are expected to give the tenant an additional refund covering the period that you have rented the place out for. So bummer news....but this does allow you extra time to make repairs, market and screen applicants. --24.154.xx.xxx

I would think double dipping is bad operation everywhere, document appliance or general cleaning and damage repairs, and the time-line to have given a months notice - could be 2months overall since today is 22nd, some places allow 15 days and others go with full months in court, gotta know your system locally. --76.188.xxx.xxx

They owe March and April. Yes you can deduct it from the security deposit, make sure you send them a list of the deductions from the security deposit. Chances are they will still owe you money, you can take them to small claims if you think they are collectible.

I wouldn't worry about double dipping, if you manage to rent before April you're very lucky and chances of collecting from previous tenants are low. --74.111.xxx.xxx
