Not sure, but I wouldn't recommend it. If a circuit blew, you'd have to ask your tenant to crawl around in the attic. I do know you can have a box outside. Several old houses do, and I did a flip 5 years ago that had to have a new service and breaker box installed. It was installed outside, like the one it replaced. --99.125.xxx.xxx

NO. Access requirements are in NEC 110.26. Raintight panels for the exterior are available but bringing all the wiring to one of those may not be easy nor low cost. --66.226.xx.xxx

The load center (breakers/fuses) must be accessible to each respective unit 24/7/365 without going thru another unit to restore any circuit, in a single house yes it could be there but it would not be convenient as on a lower floor, on occasion sub panels are located there when the attic is finished as part of the project and the install must be designed so access can be made in darkness to restore overloaded circuits (a window nearby is prolly the best you can do), a call to your building inspector would clear up any variences needed. --76.188.xxx.xxx

Don,

There is probably something in the code about easy access for emergencies.

A normal human must be able to STAND to operate the breakers, with a 3x3 foot "box" of space around them. (imagine Superman's phone booth)

The breaker panel must also be within 15 feet of the meter or add an intermediate shut off.

Use the old box as a junction box and feed wires down to a reasonable location to install your new breaker panel.

Just for fun: I had a fuse panel located over the cast iron bathtub. Had to stand in the tub to operate the fuses!

We gripe about code enforcement rules but laugh when the rules are broken by someone else.
