State Specific Question About: CALIFORNIA (CA)

My tenant is moving, they requested a walk thru inspection. the Laws say they should be able to do repairs needed. They are moving because I informed them they needed to pay me for non authorized modifications to the home. I told them not to do any other repairs or modifications. Do I have to let them do repairs that are needed.

YES.

You must invite them to do a joint walkthrough, where you will identify repairs that you plan to deduct for, and they have the right to make those repairs themselves between the time of the walkthrough and the time of vacating the property.

If they do perform the repairs and they are not satisfactory, then you have the right to charge for the additional work that must be done to make the repairs satisfactory to you and the judge.

Large scale repairs are not really what the law has in mind. In the case that such repairs are needed, then I would suggest that you carefully scope out the cost of professional repairs and make them an offer that they won't want to refuse.

I went to cut the grass oe day and saw my kitchen cabinets, toilets and carpet removed. the did some upgrades but did not finish and the work was substandard. it is a 4 bedroom house

My last tenant gave me their 30 day notice they were moving. So two weeks before their move out date I requested a Pre-Move-Out Inspection.

On that report I listed items that I would be withholding money from their security deposit and the amount I was going to charge them. This gave my tenant the opportunity to get the work done cheaper.

However I did NOT want my tenants to spackle holes and try to match the paint, they always fail and then I have to repaint the entire unit.

So on my report I listed, for example:

Cost for a professional carpet cleaning service, $150.

The cost to clean the walls and touch up paint, NO COST IF TENANTS MAKE NO ATTEMPTS TO CLEAN, FILL OR REPAINT WALLS, CEILINGS OR DOORS. If tenants try to do touch ups and make things worse, I will charge them a prorated amount to repaint the entire apartment, approximately $600.

I don't know how much SD you have, but repairs for kitchen cabinet removal, carpet removal & toilet removal is surely well beyond the SD. I would start a small claims action immediately while you know where you can serve them. I would not wait for them to repair it themselves. Such extensive damages are well beyond what that law intended. --104.34.xxx.xxx
