State Specific Question About: NEW YORK (NY)
As a landlord, I like to look at other landlords leases and I saw one today that I don't understand. It is a 4 family house and 2 apts share a bath & kitchen. At the top of the lease, it reads SHARED APARTMENT RENTAL AGREEMENT. Each tenat has his/her own lease but the 1st sentence of the lease says" Tenants agree to rent a shared apartment as a family unit under the H --74.65.xx.xx |

I guess as long as they (the tenants) know and understand that the kitchen and bath are shared with another unit - what's the problem with what is written?

Someone's trying to get around local boardinghouse rules.
Normally, you'd consider the kitchen and bath as "common areas", and rent just the bedrooms.
By getting people to pretend to be a family unit under the lease, they're also getting around whatever local legislation is in place to prevent a certain number of unrelated individuals from living under the same roof. --209.33.x.xxx |

It sounds like what we call a mother in law apartment around here.
I don't think that would be allowed here as a rental to two separate parties since without a kitchen and bath, one unit would not qualify as a rental.
