State Specific Question About: MASSACHUSETTS (MA) If there is a condo in an Estate that has yet to be put through probate, but there is a Lien on the property, can the Estate collect rent from the tenants living in the Condo?

Rent needs to be paid, lien or not. Why wouldn't the rent be paid to the estate?

This involves my friend's mother's estate, her sister claims she cannot collect rent from the tenants due to the Lien. And the tenants are - why of course - 2 freeloading brothers! Nasty situation. --108.20.xx.xxx |

Usually, a property can be rented (and rent can be collected) regardless of a lien.

Until the property has transferred by way of a deed-to-transfer or the foreclosure is completed and deed recorded the rent is due by way of the lease, and the HOA is of course entitled to the fees continuously based on that contract, evict the bums and get paying clients, the heirs will suffer deeply from this unless they are able to stop the clock and calendar - doubtful that can happen anywhere on this planet... --76.188.xxx.xxx |

Deadbeats will always "quote the law" to you because in their mind they know everything.
I had one person try to tell me that because the house that they wanted to purchase from me "wasn't worth anything" because the basement floor was dirt (it was an old 200+ year farmhouse in the middle of nowhere).
The lien that you are speaking of is because the owner hasn't paid the Association. Regardless of "who" was suppose to pay it (meaning if there was an agreement between the tenants or not) it doesn't matter to the Association - the Owner is always "responsible" to ensure that it is paid. That is why many owners should either include this in their rent or ensure that the tenants pay them then they pay the fees, etc (this holds true for anything like this - such as water/sewer, etc). Not necessarily for utilities as gas and electric - but that is all up to you - typically those are not the "owners" responsibility.
All in all - if the tenants are not paying - then they need to be evicted ASAP. Get out of the "brother/sister, cousin" and make the hard choice. They won't like it - but it's business - not personal. They CHOSE not to pay - so they CHOSE not to live there and be evicted if that's what is necessary. Be strong! Good Luck! --67.246.xx.xx |
