State Specific Question About: ILLINOIS (IL)

Tenant kicked boyfriend out after 9 months. He is not on the lease (I knew he was living there). Boyfriend has taken all his personal items except for his bed which he he says he doesn't have time right now to pick up. (It's now been 2 weeks).

Tenant is leaving at the end of this month. What do I do with his bed so I can re-rent the apartment?

Once your tenant gives you the keys I would discard any abandoned property and begin getting the unit ready for rent. The previous tenant is responsible for returning the property to you without damage and in good condition excluding normal wear and tear. Any costs returning the unit to rentable condition including costs that you would incur to remove abandoned property would be deducted from the security deposit. Take pictures and document your activities. I would give the existing tenant a move out document stating their responsibilities. There are some IL rules about abandoned property so I would look those up. Myself I would contact the existing tenant as part of the move-out and tell them your expectations on move-out. --74.83.xx.xxx

As far as you are concerned it is your tenants bed. Hold on to any security deposit as long as you can and use that as leverage to have the tenant get rid of it. Follow your state laws OR you could be charged for the bed you improperly disposed of.

He was never a tenant. How could you possibly end up with his property in your rental?

Jim in OC has it right. It is the tenant's problem, not yours. If it is there when the tenant leaves, charge the tenant for removal and disposal, and take it out of the deposit. Even if you want to keep it, charge the tenant for removal. --174.29.xxx.x

I've never delivered left behind "valuables" to the front door.

But I did deliver a whole pile of stuff in garbage bags to the driveway once.
