State Specific Question About: PENNSYLVANIA (PA)

So I did my first eviction. Went through the whole process with district court and got a judgement of about $3,000. One of the roomates makes a good living but wouldn't pay the rent bcs the other didn't pay his half. I believe the one may try to buy a house in the next few years so I want to record the judgement so it's on 'his record' when he applies for a mortgage. Can someone please tell me how to do that? --98.114.xxx.xx

In my county. I had to get an actual stamped official copy of the judgement from whatever department window, cost free. Then i had to go another window in the recorder of deeds office to file cost about $30. Any title company and see it, or so i'm told. I called and they were a bit helpful. Thanks Razorback_tim. THat's a good idea. An attorney friend told me that in PA it's a 'no.' But I heard otherwise from someone else. So I'm not sure yet. First I just want to make sure it's recorded then I'll start pursuing time consuming/expensive options. --98.114.xxx.xx

Randall -- Many times the roomys try to say I paid my half and roommate didn't. We like you don't have HALF rents. Be sure you have the clause that defines-- none splitting of rent between roommates. They are Solely responsible for total rent.

Once your case is decided it is public record and will be placed on the credit reporting record once the agents for the credit company's get the court tapes. The major CCard company's scour court records to keep their files updated.

We have had on occasion one or 4 get missed so follow thru with Jeffery's site. That will assure you its recorded.

Would like to suggest this-- you have the judgement and maybe some additional money owed. Have your total $ ready and call the collectible roommate. Let him know your intentions. Advise him you know he's looking to buy a home and you would like to keep this off his record-- then negotiate something you can live with. Offer a payment plan-- offer no interest-- anything you can to get $ coming in. You may be in a state that doesn't garnish but you ARE in a state that checks credit history for loans and mortgages. That's your lever. Remind him that with the judgement he can't get a job requiring any bonding-- law offices stock brokers etc.. If no agreement reached the chips will fall where they may-- he will owe the hole amount if it ever gets that far. OR if he has a need.

I will keep posting this to your credit until we come to an agreement OR pay and I will submit a paid in full receipt to you for your portion.

Then proceed to roommate 2. Squeeze #1 for the last drop then move on. --74.184.xxx.xx

as NE says - record it at the Prothonotary. That is step one for several options.

No need to report it to credit bureaus - they will automatically pick it up.

The attorney who informed you wage garnishment wasn't doable is outright wrong. You can garnish for landlord tenant judgments. It only makes sense if he has has a decent job. You want to be certain he won't quit when the first payment comes out of his check. You also want to be certain he doesn't fall under federal poverty guidelines.

Garnishment takes a while to collect $3000. Have you considered executing on his "personalty"? that means the constable or sheriff will go into his home and write down anything that appears to be of value - electronics, furniture, jewelry, etc. They will then sell it - the idea behind that is they will actually pay you rather than have their items sold for pennies on the dollar and still owe you a lot of money. You can also levy on his bank account.

if all else fails, the judgment will be an issue some day and he'll pay.

Also, from the day it's filed, they owe you 6% interest. --72.95.xx.xxx

You can garnish wages in PA for judgments from a Landlord/Tenant action but not from a judgment from a civil action. Your next step is to wait the 30 days then record your judgment at the prothonotary. I would start with sending the sheriff to knock on the door to collect 1st with bank til second and garnishment 3rd. --74.111.xxx.xxx

so now we find out YOU can garnish in PA. Great news.

The sheriff route is good but takes so long and many times you just wind up with a lien on a piece of junk truck or car.

What does get the defendants attention is when there served at work by the sheriff. That my friends gets a tenant's attention.

I stand by my post to try to negotiate this out with the collectible tenant. Now that we know you can garnish whole new ball game. Whole new set of levers. --74.184.xxx.xx
