State Specific Question About: PENNSYLVANIA (PA)

Does one have the right to not renew a tenant's lease and if so how far in advance prior to their current lease expiration date.

YES, of course one does.

Unless, he has complained to you about habitability recently. Check your state law for retaliatory eviction.

Landlord does not need to give him ANY notice that his lease will not be renewed (he already has notice of the expiration date) but of course, a courtesy notice would be useful so that neither he nor you will be surprised.

What does your lease say? My annual lease renews for another year (instead of converting to month to month) unless I or the tenant give notice at least 30 days prior to that renewal. --166.137.xxx.xx

If it is a one year lease I believe it is only 30 days but some magistrates want a 60 day non-renewal notice. --74.111.xxx.xxx

Leanne,

Start by reading your lease. The answer may already be spelled out. 30 days is typical unless your state or local law requires longer. Like Ed said, get some LOCAL info.

Everything is negotiable. Why do you want them out? Do you need to talk to them about moving sooner? Will this be a difficult resident?

My lease is clear: automatically renews with a 2.9% Cost Of Living increase unless there is a 60 day notice provided by either LL or res.
