State Specific Question About: CALIFORNIA (CA)

Can I require tenants beginning a 1 year lease, as a condition of the lease, to pay at the beginning of the lease 12 post dated checks that will not be cashed until the date the rent is due? Can I do that for tenants on a month t month tenancy , as well, requiring them to pay a minimum of 6 post dated checks that would be returned to them if they move out before 6 months. --104.180.xx.xxx

What's the point of doing that? If they end up changing accounts, banks, etc OR they don't have money in the account when you go to deposit it - it is not going to help you.

Also - in my leases (and my preference) is that I do NOT receive any payments Post dated - I don't want to hold on to anything - once I receive the payment I expect to be able to deposit/use it. --67.246.xx.xx

I've often thought about that. It does elimiate the lost checks etc but not the lack of funds.

Take it one step further and reduce your stress: autodraft and a deposit only account at your bank.

Autodraft TAKES the money when it's due. THAT is what you are after isn't it?

Deposit only account lets people who cannot handle autodraft pay their rent in person. (Our local employers are shifting to paycards rather than paychecks or auto deposit of pay.)

Part of our Bad Check Law in GA says. If you take a post dated check and even if you deposit it when your suppose to and it bounces you can't go after the bad check. Sounds crazy but hey what can you say.

We don't take post dated checks. They also increase the amount of the felony amount on a check from 500 to over 1K. Not considered a felony any more if they don't make it good. --74.184.xxx.xx

I'm with Brad on this - try to get them on autodraft if they have a bank account. That way you are in control of drawing the rent from their bank account. No late payments ever unless there isn't money in their account in which case you know PDQ and can take appropriate action. I give a discount to tenants paying via autodraft (I really get the rent that I want if they pay via autodraft and get more if they don't). --70.178.x.xxx
