State Specific Question About: WASHINGTON (WA)

2 tenants signed a 6 mo. contract. She paid entire deposit and 2 months ahead.of $3,000. He's mean, she leaves. He works for UBER and his car in repair shop. He can't qualify on application. What do I do? --50.135.xxx.xx

They've already been there 2 months?

When rent goes unpaid, serve the proper Pay or Quit notice for your jurisdiction right away.

Assuming your lease covers this - Let them know that both tenants are responsible for rent, even if she's not there since she signed the lease with him.

For a residential lease, 'joint and several liability' means that each tenant is jointly AND separately responsible for the entire rent amount and for any damages.

Inspect quickly so they can be assured of getting something back or they will ruin the place, we tell them we dont want your money just a place that can be moved into in good condition like it was for you, the goal is giving it all back in 2-3 weeks, most places have a 30 day timeline so study your local and state tenant laws if you are unsure and -never- offer a refund in echange for the keys, by the law you have xxx days and you need to get a good look in daylight. --76.188.xxx.xxx

Exactly what Kyle [IN] says - don't get "caught up" in what is going on in their lives - if they both are on the lease (contract) then they both are responsible for it. It doesn't matter that one left or not.

If they are "current" with the rent and they are just advising you of what is going on then they have until the next rent payment is due to pay. If they are late now (meaning the two months have been paid and rent is due for November) then start process Monday AM (and make sure you place BOTH NAMES on it).

If it is the first one (where they are just advising you of what is about to occur) then you can (if you want) "help" them by finding another tenant now and see if it's something you can get another tenant in there before weather really hits. I would say they still are responsible for the rent until you find a tenant (but make sure that you are looking).

nonpaying tenants are like irresponsible children. they will come up with excuse after excuse to avoid the inevitable: paying rent. they go for sympathy first, ignore later, etc. i learned the hard way. evict all tenants on lease and don't let them drag out. if they don't pay after the first warning they won't pay after the sixth. --72.68.xx.xxx
