State Specific Question About: OREGON (OR)

I have a month to month tenant that has added a girlfriend, her child, her dog, 10 chickens a trampoline.and

a grow of 18 pot plants. all without prior approval.

I rented to him and his 4 yr old. I decided upon a 30 day "no cause" to vacate.

If I chose to create a "NEW AGREEMENT" can I do so, and use the words....this agreement voids all previous agreement and/or amendments.

Thanks for any help or legal assistance you could provide

You and the tenant can enter into a new agreement, and you certainly can provide in the new agreement that it supersedes all prior agreements. I would probably specify "including but not limited to the written month-to-month rental agreement dated July 16, 2014"

What it sounds like is you want only to have him, not all the other stuff

While a no cause sounds simple.. there are a number of ways to

configure it.. to defend against the 'professional tenant'

I'd suggest a LL/Tenant Atty... one that just does LL --162.247.xx.xx

Mike,

My lease is clear: no trampolines!

A law office in Indianapolis specializes in trampoline injuries...because there are so many and they are severe.

Anything is negotiable, just spell everything out clearly.

I would have him sign a letter stating "the lease dated ____ has ended."

But is this guy a keeper???

Paying rent with eggs? :)

In NY a M2M agreement requires a calendar month notification. So notice of end of agreement would have to be given before the first of the month to be valid the first of the month after.

Why would you want to keep him if he is doing all this? Just give him notice to vacate in the time required by your state. I doubt giving him a new agreement is going to change anything and you will still end up getting rid of him. --71.164.xxx.xxx
