State Specific Question About: CALIFORNIA (CA)
Went to do some work at my SFD rental house and found a 4 x 4 area of siding on my house melted from the tenants gas barbeque!!!! We purchased the home as an investment and the siding is 20 years old. It's right in the middle of the house about 4 feet high. Can not be replaced. Devalued the property!!!
I took pictures and informed the tenant that I was aware of the damage and photographed it. She didn't say anything, so I left. Where do I begin???? Who do I call??? How do I recover the damages?? Do I get a lawyer$$$$$

You will have to turn this in on your insurance. They will have to pay to replace the while house siding. I would hold tenant accountable for the deductible. I would suggest filing on tenants rental insurance, but you may not force them to have it. --166.137.xxx.xx |

You already got the most important first step -- photos!
Next, my first call would be to get some estimates to repair. Can you replace just that section or do you need to repair the entire wall? Is your siding paintable? If so, maybe you replace just that section and paint the entire wall.
I do not generally file a claim against my own insurance. I save the insurance for catastrophic damages, not for minor issues -- and I think this is probably a minor issue, thank G_d.
I would get some estimates, demand the tenant pay, and get it fixed.

Do you tell tenants they need renters insurance? you need to ask them for the renter insurance company they used. File a claim with them.
If no renters insurance-- get some quotes on repairing 2 or 3. Pick the best one for you and submit to tenant with pic's. Offer them a payment plan and escrow set up to have it fixed. Advise them it was through their negligence that the damage was done. Give them a time frame for payment. Should they not make restitution NOW you have a basis for a civil damages suite. All costs associated with the suite shall be paid by resident and shall be part of the suite.
I never claim against my own insurance. I don't need any cancellation notices. That's why we carry a 5K deductible. --74.184.xxx.xx |

Come on! Most tenants that rent live from hand to mouth with almost nothing in savings. Do you really expect tenants to pay for the damages they caused? Almost never. Even if you win a judgement in court, successful collections are less than 20%. Want to report a claim to your insurance? Well all insurance company's keep and share records. This will negatively impact all future purchases and current rates. File a claim and there a 50% chance your premiums will rise more than normal.
So what's the answer? Make sure your tenants have renters insurance with a healthy liability covering their landlord. Policies cost around $220 to $350 a year -- that's around $25 a month.... Where on the house is it located? You could replace it with siding from a different part of the house if it's in a very visible place. Then find something close or that could be painted to match to cover the area where you removed it from. --65.35.xx.xxx |

Robert J CA Here's a fact. We have over 400K in judgments and we're collection over 265K. Yes we're working on the other 135K. Time is on our side.
FACT most LL's believe as you why bother-- I say 265k IS WHY.
We have a girl who works 2 days a week 6 hours those days. All she does is find skips, hideaways, bank accounts, trucks and boats anything that can be attached and sold by the sheriff to sell to meet the judgement amount. They may not have it now but in 4, 5 or 6 years they will. LL's need to change their thinking about collections.

Hopefully we can change out these panels which are located on the middle of the patio wall about the same height as the top of a large stainless steel gas barbecue. The panels run horizontal. If it is in the middle of patio wall, you might be able to replace it with something very different, like vinyl stone look siding. It might then look like an accent area, behind the patio. Or can you get a close color and put lattice over it, so it isn't noticeable. --71.164.xxx.xxx |

YOUR insurance? No way! Each claim stays on the house's CLUE report (Permanent record). They will cancel your insurance with 2 claims, and make it impossible for a future buyer to get insurance on the house to get a loan.
We were recently cancelled because
1. hail storm damaged the roof
2. res' child started a fire inside the house.
State Farm cancelled because we had 2 claims.
Save your claims for something important.
Siding: is not expensive.
We recently had this situation on two houses, the melted area was in the center of an entire 75 foot wall of siding. The second was next to the kitchen door over a beautiful new deck.
We located a small bump out wall, or siding under the bay window, robbed the siding from that, and resided the small wall with new - it was isolated and did not need to be a perfect match.
Robert J is right about not assuming the res can pay for this. Be thrifty making the repair unless your res can pay cash now for a total re-work.
BUT...
bill them NOW and start taking payments for it. Make your paperwork clear that unpaid fees are considered unpaid rent and grounds for eviction.
DO NOT fall for "just take it out of my deposit!
Collections start with the application and lease info. We spend time on it and have greats results. It's one more set of skills for a serious landlord.
(My comments apply to normal courts. CA is it's own animal!!)
