State Specific Question About: CONNECTICUT (CT)

How long before you can consider a tenant's belongings left in the unit as abandoned? What's the legal process? Tenant moved out first weekend of Sept after a 2 week notice. returned weekend after but did not remove any other belongings. 2nd weekend after returned but wasn't going to clean (disgustingly filthy) but my college son (a friend of the tenant) helped him clean, did the majority of the cleaning knowing how upset I was over condition of the apt. Tenant said he would return last weekend to finish cleaning and removing belongings (furniture, clothing, kitchenware, food, etc.) but he did not. I sent another text and he told me what remains is garbage and I quickly replied back that he was responsible to remove it all, NOT ME as well as clean the apt back to the condition he rented it in AND return my key. I've been taking pictures with date cards to document, he knows this. I don't think he's coming back and he's had no communication with us since. I need to get the place rerented, plan on taking him to court, but need to know when and how I can begin to remove his stuff. TIA --69.119.xxx.xxx

I never let a tenant back into the house after they

move for fear of the damage they may purposely do. Especially after they returned the key. Don't beg him

to come back to clean, just have it done and charge him for

Have to file eviction, it is the fastest way to recover the unit, use your place as last known address or workplace, many companies sign for employees and in OH that is proof of service so the case goes up to the docket. Take photos and have repair estimates for cleaning, hauling, fixing damages, painting, missing rent and keep your story short - tenant packed up and advised us he was leaving and this is what she/he left, we are getting it ready to rent again after all these repairs, cleaning and painting, the total repair cost without wear-n-tear is xxxx bux. --76.188.xxx.xxx

These guys don't give a hoot. I'm surprised they did as much as they did.

Take a photo of the text on your phone screen or print it out to have as evidence if challenged. Phones got lost, break, stolen, or dropped in Lake Erie while riding with Vee setting a new cross lake speed record!

Get him to send you a text saying he and all roommates return possession to you. Or send him a text stating that asking him to reply CONFIRMED.

Get in there and take care of your investment - carefully.

Me? I post an ABANDONED PROPERTY NOTICE on the door printed on hot pink paper, bag up the spoilables, and pile the rest in the center of the room or the garage.

OR...

better yet, DELIVER IT ALL to his new address or his Momma's house - she was listed as his Emergency Contact right?

I am not advocating anything illegal, but somebody has to step up and get this thing re-rented.

Good question. How long before you consider it abandoned? If you don't see the keys left for you on the counter-- not until it's returned to you by the court. You do have a right to protect the property by securing it. Start the paperwork right now-- don't wait. In the mean time copy the my stuffs trash email or text but get a key. Your son should help you with this friend of his to get them.

Scolding someone to Clean up and return in condition it was given to you is wasting your time. There filthy and have no intention of cleaning. the more they can drag it out the less guilty they feel. It's now the LL's problem.

So get the key make the damages list and move forward. You do need to have legal possession not just he said he was done. --74.184.xxx.xx

Boom. You had notice, tenant was out, anything left behind is now junk and abandoned. Haul it off, change locks, you are done. If you need help, post an ad on Craigslist, "Free junk, doors open at 8 am, you haul off." Have a helper there by 7 am to keep an eye out so someone doesn't steal the vanity or water heater. I'm not kidding, those CL scavengers will TRY to take anything not nailed down, and some bring hammers and crow bars to "un-nail" stuff.

I would not have sent that 2nd response text. Once he said, "it's garbage" you had his written permission to remove it all. I would've printed that text and hired my trash-out crew. Unfortunately, by responding to him that he's responsible for moving it, now there's written proof that you do NOT consider the property abandoned because you still consider him responsible for HIS property--abandoned property has no owner. Responsibility implies ownership. I think you just converted your house into a free storage unit until your state's abandoned property timeline expires. Talk to your attorney and find out what he recommends.

SID once she said you are responsible to remove it all she gave the tenant the property back. She has not accepted the property. Yes big mistake.

LL's want people to clean up so they don't have to and keep putting their foot in their mouths by doing so. They ain't cleanin up. The second the key is left and or they say their done inside- bam it's yours. Accept it. It being the property.

Are you sure you didn't take a picture of the key left the same day you got the text about it's all garbage-- I would look again. --74.184.xxx.xx

Not sure if CT allows, but in MA we can ask the housing court for an injunction order for possession if we can prove " it is more likely than not" that the tenant has abandoned the property. That gets you possession without eviction and a sheriff. Are the utilities shut off? Sounds like the text plus no contact would be enough. --70.215.xx.xxx

If the bed is gone along with other furniture unlikely the tenant will be returning. Often tenants buy new furniture for the new rental unit. Take pictures then see if one can file with small claims court for cleaning and damages along with arrears of rent if there is arrears. If there is a dead bolt then one can take the dead bolt out to a locksmith to have the dead bolt mastered and rekeyed. This is possible with a grade 1 or grade 2 dead bolt. If one needs more specific advise before doing anything then contact a landlords association where there are listings on this site or google to find one near the rental. --74.220.xxx.xxx

Our housing court just did a big discussion about this, death, tenant in jail, hospital extended stay - none of them count unless you serve legal notice you are taking over by default lease action, court 24 days is faster than 60 days abandonment in my area. --76.188.xxx.xxx

Big mistake. If the T's response saying "it is all garbage" was in written form (and to me, that includes a text message), I would not have said "no." I would have sent in a trash-out crew to remove the junk and clean the place and do whatever rehab was needed.

If it was not in written form, my immediate goal would have been to get it in writing somehow, so I could get rolling on the project.

Instead, by demanding that the T remove the junk, you have wasted what -- two weeks or so? And the place is still not clean.

My goal is NOT to force the T to clean the place. My goal is to get the place re-rented as quickly as possible, to get the rental cash-flow operating again. And generally that means my getting possession as soon as possible so that I can get the property ready to show!

ok I get it. I made a mistake...but I thought since he had not returned the key AND had told me he would be back the following weekend that he still legally had possession and I would have to legally notify him somehow (Cert. letter, court notice?) that I was taking possession of the apt back and cleaning it out. That was my original question. You've all helped quite a bit. Thanks! =)
